De igual modo, a presente dissertação procura definir a justiça restaurativa e enquadra-la nos atuais modelos de política criminal, discorrendo-se sobre o multímodo do seu conceito e abordando, outrossim, o problema das finalidades, em especial, o papel da reparação bem como as suas modalidades. Descreve-se o instituto da mediação penal como o principal instrumento ao serviço da justiça restaurativa, as suas modalidades, em especial a mediação penal de adultos, bem como o seu regime à luz do direito português, apontando-se algumas razões para a sua aparente volatilização. Sistematizam-se alguns dados de natureza estatística sobre a mediação Penal em Portugal entre os anos de 2008 e 2018, procurando-se tomar uma conclusão e explicar o porquê da sua volatilização no ordenamento jurídico português. De igual modo, discorre-se sobre o fenómeno do net-widening ou diversão como fenómeno de alargamento do espectro da reação jurídico-criminal ou alargamento do âmbito punitivo, o seu aparente intra e transistemático paradoxo e o seu efeito na chamada transitional justice. Procede-se ao enquadramento da justiça de transição como um conjunto de processos de transição levados a cabo no quadro de transformações radicais em uma determinada ordem político-social e de como, de certa forma, a própria justiça de transição acaba por consubstanciar um alargamento e aprofundamento da rede de punição por promover um fenómeno de net-widening e net deepening.This dissertation approaches the phenomenon of restorative justice. In the same way, the present dissertation seeks to defining and framing restorative justice within the modern models of criminal policies. This work also discourses on the multimode concept of restorative justice as well as it approaches the problem of the purposes of punishment, especially, the role of restitution and its types. This dissertation also sets out to describe penal mediation institute as an alternative dispute resolution means, the main instrument on behalf of restorative justice as well as its regime under portuguese law pointing out some reasons to its apparent disappearance. Statistical data on penal mediation in Portugal from 2008 to 2018 is also systematized seeking to draw a conclusion as to its disappearance within the portuguese legal order. In the same way, this dissertation expatiates on the phenomenon of net-widening or diversion as a phenomenon of enlargement of the juridical-criminal reaction or punitive scope, its apparent intra and transsystematic paradox and its effect on the so-called transitional justice.
