Nesse cenário, assume especial relevância a chamada “Revolução GNR” – Genética, Nanotecnologia e Robótica –, proclamada entusiasticamente por cientistas e futuristas que sonham com um mundo feito à medida e imagem do ser humano, agora, porventura, elevado à categoria de Homo Deus. Se até há relativamente pouco tempo tais pretensões não passavam de desejos oníricos e tecnicamente inalcançáveis, os avanços no domínio da genética têm aberto portas a um mundo de potencialidades, tanto surpreendentes, quanto aterradoras. Parece, pois, que Prometeu, símbolo mitológico do progresso, ameaça desagrilhoar-se e dar à humanidade a chave para o controlo da própria vida e de tudo aquilo que a rodeia. A sua libertação não se fará, porém, sem o despoletar de profundas tensões entre as várias forças dialogantes e a transformação das estruturas societárias, o que não deixará de apresentar repercussões significativas no campo da Ética e do Direito. Assim sendo, ao longo desta investigação, procuraremos aflorar alguns dos desafios da “nova genética”, focando-nos especialmente na temática da engenharia genética, mormente com o advento da revolucionária técnica CRISPR/Cas. Em seguida, partindo do conceito de vulnerabilidade e da sua relação com a técnica, examinaremos criticamente, no quadro da internormatividade, as principais normas internacionais e supranacionais que visam tutelar o património genético humano, especialmente respeitantes à proteção da identidade genética, e que assumem clara relevância em sede de regulamentação da experimentação científica em torno do genoma. A este propósito, questionaremos ainda se se estará a assistir ao surgimento de novíssimos biodireitos. Logo após, procuraremos densificar o conteúdo do direito à identidade genética no âmbito da bioconstituição lusa e analisaremos as normas nacionais em vigor em matéria de experimentação científica em seres humanos e embriões humanos, sem deixar, é claro, de fazer algumas referências à prática clínica. Por fim, procuraremos clarificar a relação entre o princípio da dignidade humana e a engenharia genética e analisaremos alguns dos direitos fundamentais e biobens constitucionalmente protegidos (sem olvidar os deveres!) que, neste domínio, tendem a conflituar, demandando cuidada harmonização. Não deixaremos, igualmente, de refletir sobre várias questões que têm ocupado o debate ético-jurídico hodierno na matéria, como é a do consentimento, do perigo de discriminação num contexto de ressurgimento da “ameaça do eugenismo” ou da tensa relação entre risco e técnica que carateriza a atual Risikogesellschaft. Concluímos que, tudo ponderado, o ordenamento jurídico se deve mostrar aberto à utilização de técnicas de engenharia genética em seres humanos quando levadas a cabo no âmbito da terapia génica somática ou da edição genética germinal preventivo-terapêutica, ainda que, neste caso, limitada a casos muito específicos (pelo menos, enquanto a comunidade científica não conseguir decifrar, de forma mais clara, qual a extensão e natureza dos riscos envolvidos). Estamos num momento decisivo da história da humanidade. O futuro, mais do que nunca, está nas nossas mãos e a batalha a travar para garantir a sua prosperidade poderá afigurar-se morosa e imprevisível. Que a presente investigação seja um contributo – ainda que humilde! – para que o ser humano seja capaz de empregar todas as suas forças para a prossecução do bem comum e, assim, trace um futuro que se afigura risonho e, quem sabe, livre de tanto sofrimento e angústia.The dawn of the Third Millennium is well-marked by an incessant search for new means which may allow the human being to overcome his fragility and vulnerability(ies). In this specific scenario, the so-called “GNR Revolution” – Genetics, Nanotechnology and Robotics – is enthusiastically proclaimed by scientists and futurists who dream of a world constructed and planned by humans, who are now, perhaps, elevated to the category of omnipotent Homo Deus. If, until recently, such claims were nothing more than pure science-fiction, the incredible advances in the field of genetics have opened the doors to a world of both impressive and frightening potentialities. It seems, therefore, that Prometheus, the mythological symbol of progress, threats to unchain himself and provide the human being the key to control one’s life and everything around him. His liberation will not, however, be carried out without the rise of deep tensions between various dialoguing forces and the considerable transformation of societal structures, which will predictably have significant repercussions in the fields of Ethics and Law. Thus, in the present investigation, we will try to highlight some of the challenges of the “new genetics”, focusing especially on the field of genetic engineering, namely taking into account the advent of the revolutionary CRISPR/Cas technology. Then, based on the concept of vulnerability and its relation with the technique, we will critically analyze the main international and supranational norms aimed to protect the human genome, especially in what relates with one’s genetic identity, and which assume clear relevance in the regulation of scientific experimentation in the field of genetics. Also, we will question whether we are witnessing the emergence of brand-new biorights. Subsequently, we will try to densify the content of the so-called “right to one’s genetic identity” in the context of the Portuguese Bioconstitution and analyze the current national legislation which regulates scientific experimentation with human beings and human embryos, not forgetting to mention the rules which apply to clinical practice. Finally, we will try to clarify the relationship between the principle of human dignity and genetic engineering and analyze some of the fundamental rights and constitutionally protected values (not to mention the duties!) that, in this field, tend to collide, requiring careful harmonization. We will also reflect on several issues that have occupied the current juridical and ethical debate on this matter, such as informed consent, the rise of discrimination in times of resurgence of the “eugenic threat” or the tense relationship between the risk(s) and the techne in the context of the present Risikogesellschaft. We conclude that our legal order should embrace the use of genetic engineering techniques in human beings when carried out in the context of somatic gene therapy and germline genetic edition for preventive and therapeutic purposes, although, in this last case, with several limitations (at least, until the scientific community is able to decipher the extent and nature of the risks involved). We are at a turning point in the history of humankind. The future, more than ever, lies in our hands and the battle to secure its prosperity can be sluggish and unpredictable.
