Primeiramente, será feito um breve enquadramento histórico, depois será abordada a questão da natureza jurídica da arbitragem tributária e a necessidade da sua implementação em Cabo Verde. De seguida, será apresentado o Regime da Arbitragem Tributária de Cabo Verde. Por último, será feita a análise de um caso prático do Centro de Arbitragem Administrativa de Portugal (CAAD). Os tribunais tributários de Cabo Verde têm recebido vários litígios nos últimos anos. No entanto, não têm sido capazes de solucionar em tempo útil os problemas que lhe são apresentados, por isso, Cabo Verde (assim como Portugal) adotou o Regime de Arbitragem Tributária, como um meio alternativo para a resolução de litígios tributários. Este regime tributário atribui ao tribunal arbitral de Cabo Verde a competência de julgar matérias respeitantes a declarações de ilegalidades relativos a atos de liquidações de impostos, taxas e contribuições, sendo que as decisões destes tribunais têm o mesmo valor que o dos tribunais judiciais.This master thesis analyzes the tax arbitration of Cabo Verde covered by the law 108/VIII/2016 of January 28th. Firstly, we will do a brief historic framework, then we will question the judicial nature of tax arbitration and the need of its implementation in Cabo Verde. After we will present the respective regime of tax arbitration of Cabo Verde, lastly, we will analyze a practical case from CAAD. The tax courts of Cabo Verde have been receiving various litigations lately. However, they haven’t shown the capability to solve in useful time the problems that they get presented with, that’s why Cabo Verde just like Portugal adopts the tax arbitration regime as an alternative means to resolve tax litigations. This regime attaches to the tax court of Cabo Verde the competence to judge matters related to illegal statements of acts of liquidations of taxes, fees and contributions.
