O principal critério de aplicação de responsabilidade ao país de primeira entrada causou impactos negativos nos países fronteiriços que não foram capazes de lidar com o fluxo, aliada a disfuncionalidade que afetou diretamente no acolhimento e na proteção dos requerentes de asilo. Essa incapacidade teve reflexos diretos com a violação de direitos fundamentais previstos pela Convenção Europeia dos Direitos do Homem e pela Carta dos Direitos Fundamentais da União Europeia. Além disso, a existente premissa da presunção de segurança dos Estados Membros e do princípio da confiança mútua, demonstraram a necessidade de invalidar a aplicação do retorno automático e elucidar a invocação da cláusula de soberania. As medidas adotadas como resposta à crise somente trouxeram soluções à curto prazo, ao invés de resolver a disfuncionalidade do Sistema. Somente nos mais recentes tempos, a União Europeia apresentou o Novo Pacto de Imigração e Asilo que apresenta algumas soluções aos problemas relacionados, mas não invalidou o principal problema do Sistema: o critério de primeira entrada. Essa dissertação tem como objeto de estudo o desenvolvimento do Sistema Europeu Comum de Asilo e os motivos que levaram a fragmentação do Sistema. Após o longo processo de instituição de um Sistema Europeu Comum de Asilo, ainda em percurso, algumas disfuncionalidades foram sendo evidenciadas e desencadearam na fragmentação do Sistema.The recent migration crisis caused by a massive migratory flux confirmed the fragmentation of the Dublin System, due to its dysfunctionality, has evidenced the genuine need to reform the system and bring new mechanisms for an effective implementation of the principle of solidarity and fair sharing of responsibility. The ‘first entry criteria’, established by the Dublin regulation about the Member State responsible for the examination of the asylum application, has caused several negative impacts on border States that could not handle the sudden influx of migrants, combined to the disfunction of the system, has directly affect the reception and protection of asylum seekers. This inability had a direct impact on the violation of fundamental rights provided by the ECHR and the Charter of Fundamental Rights of the European Union. In addition, the existing premise of the Member States presumption of security and the principle of mutual trust, demonstrated the need to invalidate the application of automatic return and elucidate the invocation of the sovereignty clause. The measures adopted in response to the crisis only brought short-term solutions, instead of resolving the dysfunctionality of the System. In recent times, the European Union announced the New Pact on Migration and Asylum, that presents some solutions for technical aspects, but did not changed at all the main problem of the Dublin System: the responsibility placed for asylum claims on member States of first entry. This dissertation has as its object of study the development of the Common European Asylum System and the reasons that led to the fragmentation of the System.
