Busca-se, com o texto, a definição de bases comuns para a nomenclatura e o conceito, bem como demonstrar quais são as teorias prevalentes nesta matéria. Passa-se então para a discussão se o transplante é possível ou não e também se apresenta uma metodologia eventualmente possível de ser aplicada para que a transferência seja bem sucedida.Fixadas as bases centrais, analisa-se o Tribunal Europeu dos Direitos do Homem demonstrando sua origem e meio de funcionamento. Evolui-se no raciocínio apresentando três metodologias por ele aplicadas para fundamentar suas decisões (margem de apreciação; consenso do Conselho da Europa e judicial dialogue) para, ao final, ser apresentada crítica à função deste Tribunal quando promove o transplante normativo com base nas técnicas decisórias empregadas.Passa-se então ao derradeiro capítulo, momento no qual se apresenta um problema específico brasileiro, qual seja, o que os Tribunais Superiores do país decidem acerca das questões relativas ao cheque. Faz-se breve explanação da constituição destes Tribunais seguida da exposição da legislação que rege o cheque no Brasil e, ao final, são tecidas críticas às decisões consolidadas das Cortes brasileiras sobre a questão, demonstrando a má utilização do transplante, além da não obediência, por parte destes Tribunais, acerca dos compromissos internacionais firmados pelo país.The normative transplant theme has a lot of material about it, such in books as in cientific articles, but none of them offers a minimum systematization to the problem itself. With this text the Author tries to set the common bases to it´s nomenclature and definition, and also demonstrates what are the predominant theories about the matter. The next discussion is wether the transplant is possible or not and the text brings a eventual methodology avaiable for application so the transferi s well succeeded. After setting the central bases, the European Court of Human Rights is analyzed, showing it´s origin and working method. On the next moment, three methodologies used by the ECHR to fundament it´s decisions are duely exposed (margin of appreciation; European Council consensus and judicial dialogue) and, as a final approach, a criticism is made about the Court when it executes the transplant using the two decision technics showed before.The third chapter rises, instant when a typical brazilian issue is confronted, wich is, what sort of decisions are adopted by the Superior Courts about the matter related to the bank cheque. There´s an exposition about the organization of these Courts, proceeding with a brief study about the laws of bank cheque valid nowadays in Brazil.
