Este trabalho, portanto, pretende oferecer um panorama acerca do modelo de controle preventivo implantado pela Constituição da República Portuguesa de 1976, de modo a desenvolver as especificidades deste, no fito de – com a ajuda de experiências externas, tal como a realidade verificada no Brasil – afirmá-lo como um verdadeiro instrumento de justiça constitucional. Para tanto, num primeiro momento, apresenta-se a gênese dos sistemas de controle da constitucionalidade, com especial atenção à realidade francesa, visto ser a autora dos princípios caracterizadores da fiscalização prévia, foco de estudo do presente; mais além, inicia-se a análise da importação desse sistema realizada por Portugal, de forma a demonstrar o caráter excepcional a ele conferido, bem como à importância atribuída ao Presidente da República nesse processo e; por fim, aborda-se os contornos da atuação do Tribunal Constitucional quando chamado a intervir no processo de criação das leis, no intuito de verificar se esta ingerência judicial constitui medida que ofende a repartição de competências do Estado ou se está amparado pelo ideal de garantia constitucional.Constitutionality’s preventive control stands out as one of the world’s verified constitutional guarantee systems that, although having won space amongst some legal orders, spreaded throughout the whole world, over the course of time, has been raising many controversies regarding its nature, considering the eminently political character that carries with it. This paper intends, therefore, to offer an outlook over the preventive control that was implanted by the Republican Portuguese Constitution of 1976, in order to develop its specificities, aiming to – with the support of external experiences, such as the reality verified in Brazil – affirm it as a true instrument of constitutional justice.
