Resumo: According to the estimates and projections of EUROSTAT and the INE, there is a clear global aging trend of the population. The aging of the Portuguese population is thus a reality, and in 2060 the population aged 65 or more years may correspond to 34.6% of the total population. Aging is a challenge for families, due to increased life expectancy and longevity, and for the state, because the dependency ratios of the elderly population will have implications on public policy and social protection. WHO has promoted the existence of an active aging, in which older people continue to play an effective role in society, providing them with the necessary guarantee of protection, security and care. The aging exacerbates the vulnerability of the elderly, promoting that they are subject to loneliness caused by retirement, widowhood, being away from home and or health problems, because chronic diseases lead to deterioration in the quality of life and create depression. All these factors mean that seniors are prime targets for victims of crime and ageism. The statistics released by DGAI by APAV and the INS Dr. Ricardo Jorge come to prove the existence of the problem of violence and abuse against the elderly, which mostly affects older women who are victims of physical, psychological and financial. Data from GNR report that the crimes committed against the elderly are mostly against property, but the crimes against persons are also worrying, because they occur crimes of physical violence and domestic violence, sometimes even in the aftermath of crimes against property and with tragic consequences. Portugal already considered the creation of the Elderly or a National Protection Committee to the 3rd Age, having been examined a petition in the National Assembly, which led to the publication of the Assembly's Resolution No. 70/2015, which recommends the government to adopt measures to promote the rights of older persons and protection in relation to forms of violence, loneliness and abuse. The Council of Ministers of August 13, 2015 approved the Protection Strategy for the Elderly and the RCM No. 63/2015, among other measures, has proposed the amendment of the Portuguese Penal Code to increase the penalties for crimes committed against the elderly and criminalize the abandonment the elderly and the denial of care or elder residence. The Ministry of Internal Affairs created the “Apoio 65 - Idosos em Segurança” program, a proximity policing program and joint security, the National Guard develops through the “Núcleos Idosos em Segurança” that created to conduct outreach work among the elderly, minimizing the impact of their vulnerabilities, through personal contact with them and conducting awareness-raising, particularly within the Operations “Idosos em Segurança”, “Censos Sénior”, “Geração de Mãos Dadas” and “Residência Segura”.

O envelhecimento da população portuguesa é assim uma realidade, e em 2060 a população com 65 ou mais anos pode corresponder a 34,6% da população total. O envelhecimento é um desafio para as famílias, devido ao aumento da esperança de vida e longevidade, e para o Estado, pois os índices de dependência da população idosa terão implicação nas políticas públicas e na proteção social. A OMS, tem fomentado a existência de um envelhecimento ativo, em que os idosos continuem a ter um papel efetivo na sociedade, assegurando-lhes a necessária garantia de proteção, segurança e prestação de cuidados. O envelhecimento agrava as vulnerabilidades dos idosos, potenciando a que estes fiquem sujeitos à solidão, provocada pela reforma, viuvez, afastamento da família e ou problemas de saúde, porque as doenças crónicas levam à deterioração da qualidade de vida e criam depressão. Todos estes fatores fazem com que os idosos sejam alvos preferenciais para vítimas de crime e de idadismo. A estatísticas divulgadas, pela DGAI, pela APAV e pelo INS Doutor Ricardo Jorge vêm comprovar a existência do problema da violência e maus tratos contra idosos, que afeta maioritariamente as mulheres idosas, que são vitimas de violência física, psicológica e financeira. Os dados da GNR referem que os crimes praticados contra os idosos são maioritariamente contra o património, mas os crimes contra as pessoas são também preocupantes, pois ocorrem crimes de ofensas à integridade física e violência doméstica, algumas vezes até na sequência dos crimes contra o património e com consequências trágicas. Em Portugal já se considera a criação do Estatuto do Idoso ou de uma Comissão Nacional de Proteção à 3ª Idade, tendo sido analisada uma petição na Assembleia da Republica, que motivou a publicação da Resolução da AR nº 70/2015, que recomenda ao Governo a adoção de medidas de promoção dos direitos das pessoas idosas e de proteção relativamente a formas de violência, solidão e abuso. O Conselho de Ministros de 13 de agosto de 2015 aprovou a Estratégia de Proteção ao Idoso e a RCM nº 63/2015, entre outras medidas, veio propor a alteração do Código Penal português para agravar as penas dos crimes cometidos contra idosos e criminalizar o abandono de idosos e a negação de acolhimento ou de permanência de pessoa idosa.
