Resumo: The present study is aimed to, in the light of the Portuguese and Brazilian legal systems, the concepts for the elaboration of an immigration planning. Making investments in third countries can create some difficulties, including residence, taxation, and succession. The immigration process, when not planned, leaves the citizen vulnerable and susceptible to various risks. On the other hand, if there is elaborate planning, the chances of success during and after migration increase significantly, whether in tax matter such as inheritance. With the aim of deepening the study of such theses, work began with the analysis of what residence and what its connecting elements, specifically in Portugal and Brazil, including addressing the convention drawn up between them. Soon after, the study of the regime of the habitual resident was carried out. Finally, it was tried to highlight immigration planning as a management tool. It can be said that, broadly speaking, the effects of using well-structured immigration planning are effective, enabling the best benefits in tax and succession matter.

Realizar investimentos em países terceiros pode gerar algumas dificuldades, entre elas, a residência, a imposição fiscal e a sucessão. O processo imigratório, quando não planejado, deixa o cidadão vulnerável e suscetível a vários riscos. Em contraponto, caso haja um planejamento bem elaborado, as chances de sucesso durante e após a migração aumentam significativamente, seja em questões fiscais ou sucessórias. Com o objetivo de aprofundar o estudo de tais teses, iniciou-se o trabalho com a análise de o que é residência e quais os seus elementos de conexão, especificamente em Portugal e no Brasil, abordando inclusive a convenção elaborada entre esses países. Logo após, procedeu-se com o estudo do regime do Residente Não Habitual (RNH). Por fim, procurou-se evidenciar o planejamento imigratório como uma ferramenta da gestão.
