Resumo: Resumo A presente pesquisa contextualiza vida, saúde e morte digna como direitos inderrogáveis no sistema jurídico, especialmente nos contratos privados de prestação de serviço, passíveis de interpretação com carga de prevalência ante demais direitos considerando os fundamentos que estruturam e funcionalizam o Estado Constitucional Cooperativo.
