spelling Processo especial de impugnação de despedimento coletivo: estudo e reflexão sobre questões controversasSpecial process of collective redundancy of challenge: study and reflection on controversial issuesCiências Sociais::DireitoDissertação de mestrado em Direito JudiciárioCom a presente dissertação, intitulada “Processo especial de impugnação de despedimento coletivo: estudo e reflexão sobre questões controversas” pretende-se analisar os pontos mais problemáticos relativamente ao processo especial de impugnação do despedimento coletivo, procurando soluções nas teses que a nossa doutrina e jurisprudência defendem sobre o mesmo e indagando acerca daquelas que consideramos serem as acolhidas pelo nosso sistema legal. Para tal iniciamos o nosso estudo com a análise do despedimento coletivo e do correspondente procedimento legal que deve ser respeitado pela entidade empregadora. De seguida, incidimos naquela que é a questão central deste estudo: o processo especial de impugnação do despedimento coletivo, analisando o processo jurisdicional para tal consagrado, e, depois, as variadas especialidades que suscitam maior dúvida e discussão. São tratadas questões como a de saber se a obrigação de devolução da compensação é um requisito essencial para a instauração da ação de impugnação do despedimento coletivo por parte do trabalhador e, entendendo que sim, qual o “prazo razoável” para proceder a tal devolução; é também indagado quanto à legitimidade ativa no processo de impugnação de despedimento coletivo, se estaremos perante a figura da coligação ou do litisconsórcio dos trabalhadores; é estudada a solução quanto à competência territorial no caso de existirem vários estabelecimentos pertencentes à entidade empregadora que procede ao despedimento coletivo em vários daqueles estabelecimentos; é analisada a possibilidade de impugnação do despedimento no decurso do prazo do aviso prévio a que a entidade empregadora está obrigada a conceder ao trabalhador; assim como a questão da análise económica da decisão de despedir por parte do juiz e a importância do assessor na análise das motivações do empregador e dos conceitos técnicos; por fim, é abordada também a fase de saneamento e questiona-se se será ou não possível o processo terminar com o despacho saneador e em que casos. Concluímos o nosso percurso com a análise de outras formas de reação ao despedimento coletivo por parte do trabalhador que o considere ilícito, como sendo o procedimento cautelar de suspensão do despedimento e a ação comum.With the present dissertation, titled “Special Process of Collective Redundancy of Challenge: study and reflection on controversial issues" we intend to analyze the most problematic points regarding the special procedure for challenging the collective redundancy, looking at the several thesis that our doctrine and our jurisprudence have defended about it and define, at last, the one that we consider to be the taken in by our legal system. To this end, we started our journey by analyzing the collective redundancy and the corresponding legal procedure that need to be followed by the employer. Then we will enter the central question of our study: the special process to challenge the collective redundancy, by analyzing the process of the jurisdictional sue consecrated to that goal, and then the specialties that raise more questions and discussion. We will deal with issues such as knowing if the obligation to return the compensation is an essential requirement to establish the process of collective redundancy of challenge by the employee, and considering that yes, we will study what is the "reasonable term" to make such return; it is also studied the active legitimacy in the special process of collective redundancy of challenge, and it is questioned if we are facing the figure of the coalition or the joinder; it is also studied the possible solution to the territorial jurisdiction when there are several establishments belonging to the employer which proceeds to collective redundancy in several of those establishments; it is analyzed if the worker is able to challenge the colective redundancy during the period of notice that the employer is obliged to grant the employee; as well as the issue that arises of economic analysis made by the judge of the decision to dismiss and the importance of the advisor at that analysis regarding the motivations and the technical concepts; finally, it is also treated the “saneamento” phase and we wonder if the process may end with the “saneador” judicial order, and in what cases.
