Vivemos em constante mutação, e percebemos, ao longo da história, uma alteração do cenário social, econômico, cultural e político que findaram, inevitavelmente, em alterações estruturais. Nesse contexto, o progressivo desenvolvimento da globalização e a introdução cada vez mais marcante das chamadas tecnologias de informação e comunicação nas sociedades modernas trouxeram novas formas de organização da estrutura empresarial, que culminaram na criação de diferentes formas de prestação laboral – entre elas, o teletrabalho.a globalização tomou conta do mundo moderno. Ultrapassou barreiras transnacionais, conectou diferentes povos e aliou novos mercados de trabalho. Impôs ao sistema econômico e financeiro a obrigação de se repensar, de se refazer e de apresentar formas alternativas e revolucionárias de atuação no mercado internacional. O presente estudo tem por escopo a análise pormenorizada do teletrabalho como uma nova forma de organização laboral. Primeiramente, traçamos um breve relato histórico acerca da evolução do Direito do Trabalho, das sociedades pré industriais às sociedades de informação. Em seguida, procedemos à um estudo detalhado do regime de teletrabalho, apresentando uma noção desta nova forma de organização laboral, suas modalidades e enquadramento jus laboral das partes envolvidas na relação de trabalho. Passamos ao reconhecimento dos reflexos do teletrabalho na nova ordem econômica mundial, e, por fim, o teletrabalho nos Ordenamentos Jurídicos Português e Brasileiro, a sua inserção nas normas brasileiras de forma expressa, através da sanção da Lei nº 13.467/2017, bem como as lacunas legislativas trazidas pela Reforma Trabalhista.The progressive transformations of the modern world are no stranger to the eyes of our society. We live in constant change, and we perceive, throughout history, a change of the social, economic, cultural and political scenario that, inevitably, ended in structural alterations.In this context, the progressive development of globalization and the increasingly marked introduction of so-called information and communication technologies in modern societies have brought new forms of organization of the business structure, culminating in the creation of different forms of work provision - among them, telecommuting. Globalization has taken over the modern world. It has surpassed transnational barriers, connected different peoples and joined new labor markets. It imposed on the economic and financial system the obligation to rethink, redo and present alternative and revolutionary forms of action in the international market.The present study has as scope the detailed analysis of telecommuting as a new form of work organization. First, we draw a brief historical account of the evolution of labor law, from preindustrial societies to information societies. We then proceed to a detailed study of the teleworking regime, presenting a notion of this new form of labor organization, its modalities and the labor jus framework of the parties involved in the employment relationship.
