Global Labour Market for Professional Football Players and Contract Law

Resumo: The multibillion industry of football offers a product that has a global market for supply and demand. Transnational federations have a private association status linking them and their members by private membership contracts. Their authority is to organise competitions and regulate the sport discipline. Their norms affect the employment interests of professional football players as laid down in their national employment contracts. The EU has made efforts to put these transnational norms under its internal market law control in order to respect the freedom of contract between individuals but also to protect the players that are the weaker party of the contract and safeguard the undistorted competition between clubs in the market. As the industry becomes more liberalized the need for a permanent social dialogue and monitoring of the financial fair play seems appropriate.

As federações transnacionais constituem associações privadas a que os seus membros se ligam através de contratos privados de adesão. A estas federações são reconhecidos poderes para organizar competições e regular a disciplina desportiva. Uma vez que os contratos nacionais de trabalho refletem as referidas normas, estas afetam os interesses laborais dos jogadores profissionais de futebol. A UE tem desenvolvido esforços para colocar estas normas transnacionais sob o controlo do direito do mercado interno, para defender a liberdade contratual entre indivíduos, mas também para proteger os jogadores que são a parte mais fraca do contrato e evitar uma distorção da concorrência entre os clubes que integram o mercado europeu.
