To this end, both foreign and national laws and other relevant diplomas are detailed in the study, as they were essential for the construction of the incrimination as it is described today.One of the crucial aspects of the present study is to delimitate the definition of companion animals in order to establish which animals can be included in such a category and therefore be protected by the law. From what it can be verified, this definition should cover any animal that has the characteristics described in the type, namely, the ability to entertain and keep company to humans, measured in each specific case, as long as the animal is not excluded from the scope of the norm by national legislation. It seems to make sense to attribute the sense of responsibility to the human beings who domesticate animals by removing them from their natural habitat, exposing them to artificial conditions that numb their most basic instincts.Further in the study an attempt to decipher the legal good is made with the purpose of legitimize the incriminations that protect companion animals in the Portuguese Penal Code, the abandonment crime included. Finally, article 388.º of the Portuguese Legal Code is critically analyzed. A reflection is made on its inconsistencies, namely, the confusion between the incriminated conduct and the result of danger (danger in providing food and care). The incriminated conduct should be the lack of provision of food and other due care to the animal, which could endanger their life, physical integrity or health. This standard is also compared with other legal types that protect people, concluding that the incriminations that protect animals should be built independently and not be a simple adaptation of those already existent for humans.O presente estudo tem como objetivo a análise crítica do crime de abandono de animais de companhia, preceituado no art. 388.º do CP português. Para tal, procede-se a uma exposição da legislação e de outros diplomas relevantes, tanto internacionais como de direito interno, que foram fundamentais para a construção da incriminação tal como hoje se encontra redigida. Num segundo momento, delimita-se o conceito de “animal de companhia”, previsto no art. 389.º do CP, uma vez que tal é fundamental para percebermos que círculo de animais é tutelado penalmente. Verifica-se que a norma deverá abranger qualquer animal que apresente as características descritas no tipo, nomeadamente, a aptidão para entreter e fazer companhia ao ser humano, através de uma aferição no caso concreto, desde que o animal não seja excluído do âmbito da norma pela legislação nacional existente. Parece fazer sentido atribuir a responsabilidade ao ser humano que, ao domesticar os animais, os retira do seu habitat natural, expondo-o a condições artificiais que adormecem os seus instintos mais básicos.De seguida, e de forma a legitimar as incriminações que protegem os animais de companhia no CP no plano constitucional, incluindo o crime de abandono, é feita uma tentativa de descodificação do bem jurídico presente em tais incriminações. Por último, procede-se à análise crítica do art. 388.º, refletindo-se sobre as incongruências da redação, nomeadamente a confusão entre a conduta incriminada e o resultado de perigo (perigo para prestação de alimentação e de outros cuidados). A conduta incriminada deveria ser, precisamente, a falta de prestação de alimentação e de outros cuidados devidos ao animal, suscetíveis de colocar em perigo a vida, a integridade física ou a saúde do animal.
