O objetivo desse estudo é demonstrar suas principais aporias e apresentar as suas diferenças em face dos demais crimes internacionais. A presente dissertação tratrá da jurisprudência mais recente do Tribunal Penal Internacional e das principais correntes doutrinárias a respeito da matéria. Ao final, formularemos uma definição para o crime de perseguição contra grupos ou coletividades. Em primeiro lugar, analisaremos o papel da igualdade no direito internacional penal, que é substancial. Posteriormente, comentaremos a relação desse princípio com os crimes contra a humanidade, em relação à mens rea , ao actus reus e ao bem jurídico. Concluiremos que, em geral, essa categoria penal não visa proteger a igualdade dos seres humanos, mas que uma das suas subcategorias tem essa função: os crimes persecutórios. Em atenção ao crime de perseguição, estudaremos a sua história, os seus elementos subjetivo e objetivo e a exigência de uma conexão com outros atos ou crimes. O ponto de partida será o Estatuto de Roma do Tribunal Penal Internacional. Chegaremos à conclusão de que a perseguição consisite num crime de intenção dirigido contra membros de grupos ou de coletividades selecionados à luz de critérios predominantemente respeitantes à perceção subjetiva do perpetrador. A perseguição ocorre com uma privação contrária ao direito internacional de direitos fundamentais das vítimas com o objetivo da sua remoção da sociedade. O crime ofende a igualdade na medida em que o seu animus discriminatório se manifesta na intenção (realista) de expulsar do corpus social certos seres humanos vistos como inferiores. Como é cometido no contexto de um ataque generalizado ou sitemático contra uma poplulção civil, também viola a dimensão coletiva da dignidade humana.The crime against humanity of persecution is one of the prime examples of a crime under international law. The goal of this study is to demonstrate its main aporias and to present its diferences regarding the others international crimes. The present dissertation will discuss the newest jurisprudence of the International Criminal Court and the main schools of thought in respect to the subject. Finally, we will formulate a defintion for the crime of persecution of groups or collectivities. First, we will analyse the role of equality in international criminal law, wich is substantial. Afterwards, we will comment the relationship of this principle with the crimes against humanity, regarding the mens rea, the actus reus and the protected legal interest. We will conclude that, in general, this crimianal category does not sought to protect equality of human beings, although one of its subcategories has this function: the persecution type crimes. Regarding the crime of persecution, we will study its history, subjective and objective elements and the requirement of a nexus with other acts or crimes. The starting point will be the Rome Statute of the International Criminal Court. We will arrive at the conclusion that persecution is a crime of intent directed against members of groups or collectivities selected in light of criteria concerning predominantly the subjective perception of the perpertrator. The persecution happens with the deprivation of fundamental rights of the victims contrary to international law with the aim of their removal from society. The crime injuries the equality because its discriminatory animsu manifests itself in the (realistic) intent of expulsion from the societal corpus of human beings viewed as inferiors.
