Diante disto, interpela-se um panorama de Perplexidade a partir da qual emergem proposições alternativas à Justiça Criminal e até ao Direito. Esta fragilidade e crise requer um tratamento, pelo qual analisa-se juridicamente o Abolicionismo Penal. O problema que norteia a presente pesquisa diz respeito à estruturação dos saberes penais propriamente dito, entre Juridicidade-Penal, Abolicionismo e Dogmática Penal, procurando tentar responder à questão se há uma total incompatibilidade entre as pressuposições destes pensamentos ou se acaso há a possibilidade de um diálogo. Assim, dentre os objetivos traçados, tem-se a identificação dos Pressupostos Teóricos destes pensamentos, bem como de suas respectivas Expressões Criminológicas; a análise de Pontos Cegos em cada lado destas mesmas Expressões; contraposição entres os Pensamentos e, por fim, a construção da possibilidade de diálogo a partir da relação entre as críticas abolicionistas, as intencionalidades jurídicas e os pontos cegos do direito. No primeiro capítulo efetuou-se uma releitura acerca dos Pressupostos Criminológicos, em especial o abolicionismo e o atual estado actuarial. O segundo capítulo abordou a Desconstrução de Jacques Derrida e o sentido do Direito em Castanheira Neves, bem como a proposta de reconstrução da Jurisdição Penal em Antoine Garapon e em Pedro Caeiro. No terceiro capítulo, um tentativa de síntese do abolicionismo, seguido de um tratamento jurídico dado às limitações do pensamento abolicionista, da mesma forma que um link foi efetuado entre as críticas abolicionistas e três pontos que rondam ainda o Direito Penal. Pretendeu-se, ao final do trabalho, demonstrar a importância em insistir na tentativa de diálogo entre os distintos Terrenos plurais que interpelam este incipiente século XXI, dentro do qual uma tentativa de reconstrução jurídica demonstra-se imperativo.The current state of legal and criminological thinking presents a general picture of disruptions and pluralities, in face of which a criminal-legal continuity proves to be an arduous task. In view of this, a panorama of Perplexity emerges from which alternative propositions to Criminal Justice and even Law emerges. This fragility and crisis require a treatment, through which Penal Abolitionism is juridically analysed. The problem that guides this research concerns the structuring of criminal knowledge itself, between Criminal Law, Abolitionism and Criminal Dogmatics, trying to answer the question whether there is a total incompatibility between the Assumptions of these thoughts or whether there is a possibility of a dialogue. Thus, among the outlined objectives, there is the identification of the Theoretical Assumptions of these thoughts, as well as their respective Criminological Expressions; the analysis of Blind Spots on each side of these same Expressions; opposition between Thoughts and, finally, the construction of the possibility of dialogue from the relationship between abolitionist criticisms, legal intentions, and the blind spots of law. In the first chapter a re-examine of the Criminological Assumptions was carried out, in particular abolitionism and the current actuarial state. The second chapter addressed Jacques Derrida's Deconstruction and the sense of Law in Castanheira Neves, as well as the proposal for the reconstruction of the Criminal Jurisdiction in Antoine Garapon and Pedro Caeiro. In the third chapter, an attempt to synthesize abolitionism, followed by a legal treatment given to the limitations of abolitionist thought, in the same way that a link was made between abolitionist criticisms and three points that still surround Criminal Law.
