Resumo: | Nowadays Internet has become the most important way of communication in our society, being, sometimes, described as a tool for democracy. The complete access to the Internet, and not only to an exclusive part of it, its essential to assure the protection of Fundamental Rights of End Users, e.g Freedom of Speech. The Internet is also the perfect platform for the development of new companies, so, again, the full access to the Internet it’s the perfect environment for new businesses. On the other side the Internet Service Providers need to make sure that the access to the Network its efficient, this implies that they need to apply Traffic management techniques, which, in theory represent a contradiction to the principle of Net Neutrality. The Net Neutrality principle demands that all the traffic circulating in the Network must be treated the same, but in many occasion that are situations that allow the application of traffic management techniques (e.g keeping the integrity of the network). The controversy arises when, the Internet Service providers apply measures with commercials goals, like Zero Rating offers, instead of technical goals. This types of practices could imply some depreciation of Net Neutrality value, because practices like Zero Rating can create a fragmentation within the Internet, and one of the main purposes with the Internet creation was the development of one platform accessible to everyone without any type of discrimination within users. |

Assim, o acesso ao seu todo e não apenas a uma parte é essencial para ficarem assegurados os direitos do utilizador final; (nomeadamente, o direito à liberdade de expressão). Contudo a internet, consiste também numa plataforma para o desenvolvimento de novas empresas, sendo o acesso a uma internet aberta e neutra um ambiente propício ao desenvolvimento de novos negócios. Por outro lado, é necessário que os prestadores de serviços de acesso à internet garantam um acesso eficiente à mesma, o que implica a aplicação de medidas de gestão do tráfego. Desde logo as medidas de gestão do tráfego representam, teoricamente, uma contradição em relação ao princípio da neutralidade da rede segundo o qual o tráfego deve ser todo tratado de forma igual. No entanto, como se verá, existem necessidades de ordem superior (manutenção da integridade da rede) que conduzem a um desvio deste princípio. A situação torna-se problemática quando estes prestadores de serviços adotam medidas, com objetivos de ordem comercial (e não técnica), como sejam as ofertas zero rating, por exemplo.
