O termo é aplicado pela doutrina e pela jurisprudência por conta da dificuldade em se caracterizar, com certeza, tratar-se de um contrato de trabalho subordinado ou de trabalho autônomo, já que o requisito da subordinação não se encontra claro e visível. O fenômeno resulta das novas formas de organização empresarial, surgidas após a década de 70, com o modelo toyotismo ou pós-fordismo. Os elementos caracterizadores dessa relação de trabalho são: a continuidade da relação; a natureza preponderantemente pessoal; a remuneração; a dependência econômica; e, a existência de colaboração ou ligação funcional. De todos os elementos, a dependência econômica é a característica mais relevante. O trabalhador que mantém esse tipo de relação laboral acaba não recebendo a proteção do Direito do Trabalho, pois não preenche perfeitamente os pressupostos necessários à configuração do trabalho subordinado, especialmente se adotado o conceito clássico e restrito de subordinação jurídica pelo qual o trabalhador acolhe o direcionamento do tomador de serviços na execução de suas tarefas. Por outro lado, também não usufrui das vantagens do trabalho autônomo, especialmente no que tange ao poder de negociação, tornando-se dependente economicamente de seu cliente e, portanto, numa relação de sujeição à vontade do tomador de seus serviços. Para alguns, uma das formas mais modernas de parassubordinação pode ser identificada no uso de plataformas digitais para captação de mão de obra, fenômeno conhecido como “uberização” e que vem se expandindo rapidamente por vários países. Diante desse contexto, importante a reflexão sobre o tema e a busca de soluções que visem à proteção das relações de trabalho.Parasubordination represents an intermediate zone between subordination and autonomy. The term is applied by doctrine and jurisprudence because of the difficulty in characterizing, it is certain, a contract of subordinate work or autonomous work, since the requirement of subordination is not clear and visible.The phenomenon results from the new forms of business organization, which emerged after the 1970s, with the Toyotism or post-Fordism model. The characterizing elements of this working relationship are: the continuity of the relationship; the predominantly personal nature; the remuneration; economic dependence; and, the existence of collaboration or functional linkage. Of all the elements, economic dependence is the most important feature.The worker who maintains this type of labor relationship ends up not receiving the protection of the Labor Law, since it does not perfectly fit the necessary presuppositions for the configuration of the subordinate work, especially if adopted the classic and restricted concept of legal subordination by which the worker receives the direction of the service taker in the execution of his tasks. On the other hand, it also does not enjoy the advantages of autonomous work, especially as regards negotiating power, becoming economically dependent on its client and, therefore, in a relationship of subjection to the will of the borrower of its services.For some, one of the most modern forms of parasubordination can be identified in the use of digital platforms to attract labor, a phenomenon known as "uberization" and that has been rapidly expanding in several countries.
