Destarte, num primeiro momento, ausculta-se a relação médico-paciente e a sua evolução, desde o paternalismo autoritarista até ao reconhecimento da autonomia daquele último, como pleno interventor na relação jurídica. Logo depois, faz-se o enquadramento legal do consentimento informado, quer no ordenamento jurídico nacional, quer perscrutando alguns ordenamentos internacionais, por meio de Direito Comparado. De seguida, analisam-se os pressupostos de legitimação do consentimento, as possibilidades de o declarar e os vícios que o podem afetar e silenciar. Nessa sequência, trilha-se o caminho da responsabilidade civil por ato médico. Nesta lógica, pretende-se realizar uma pesquisa descritiva e explicativa, perscrutando-se a doutrina mais expressiva no âmbito da temática proposta. Bem como, examinar a legislação e jurisprudência no ordenamento jurídico português e estrangeiro, com a perspetiva de compilar e compreender os caminhos apontados pelo legislador e pelo julgador. Partindo dessa premissa, verifica-se que é com um olhar aguçado que a doutrina e a jurisprudência nacional e internacional analisam esta matéria. Conclui-se que a doutrina do consentimento informado está em constante mutação, integrando missão do Direito fornecer soluções adequadas às problemáticas provocadas pelo seu silenciamento. Comprovou-se que ainda persiste uma ampla esfera para discussão e investigação no que concerne, por um lado, às formas de combate ao silenciamento do consentimento e por outro lado, a necessidade de um novo olhar do Direito para a Medicina, por meio da construção de uma definição legal de ato médico, da tipificação do contrato de prestação de serviços médicos e de um tratamento jurídico autónomo da responsabilidade civil por ato médico.A perfunctory contemplation of the informed permission makes possible to support the axiomatic affirmation of what this one presents himself as the marrow of the doctor-patient relationship, settled on a communicational basis, conducive to a serious, conscious, free and explained decision. Being so, on a first moment we pretend to seek out the doctor-patient relationship and its evolution, from the authoritarian paternalism to the recognition of the autonomy of that last one, like full inspector in the legal relationship. Immediately after that, it is created a legal framework of the informed consent, whether in the national legal field, or seeking some international fields, by means of the Compared Law. Meanwhile, the legitimate assumptions of the consent will be analyzed, as well as the possibilities of declaring it and the vicious that can affect it or even silence it. Following this sequence, it is expected to build the path of liability by medical act. Following this reasoning, it is pretended to make an explicative and descriptive research, scrutinizing the doctrine more expressively in the specific area of study. As well as, examine the legislation and the jurisprudence in the Portuguese and foreign legal field, with the perspective of compile and understand the paths indicated by the legislator and the judge. Assuming this assumption, it is noted that the doctrine and the national and international jurisprudence analyze this subject carefully. In conclusion, the doctrine of the informed consent is constantly mutating itself, being one of the missions of the Law to supply suitable solutions to the problems provoked by its silencing.
