E, para isto, é de suma importância ter em mente o que abrange a corrupção. Entretanto, por se tratar de um tema demasiado complexo, somente serão abordadas as questões fundamentais para o desenvolvimento deste trabalho. Quais sejam: I. A relação entre o Estado Democrático de Direito e a Corrupção; II. O caráter multifacetado da Corrupção; III. Se existe uma definição de corrupção; e, IV. O que compõe o chamado Direito Administrativo da Corrupção e os seus benefícios na luta contra a corrupção. O segundo capítulo abordará os valores e os princípios do Direito Administrativo da Corrupção. Inicialmente, será feita uma breve introdução acerca dos conceitos da Boa Administração e da Governança Pública e verificaremos de que forma elas se relacionam com os princípios e valores do Direito Administrativo da Corrupção. Adentrando efetivamente neste ponto, serão estudados os conceitos de ética e moral para podermos perceber a importância do valor da ética pública e do Princípio da Moralidade Administrativa. Temas estes que possuem uma estreita relação com o valor da confiança e a, consequente, legitimidade do Estado Democrático de Direito. Desta forma, será feita uma breve explanação acerca deste valor. Além disso, o Princípio da Imparcialidade também será discutido neste item. Geralmente, o foco aqui está relacionado aos casos de impedimento e suspeição, que usualmente são definidos por Lei. Porém, será dado um passo atrás para analisar com uma maior intensidade os interesses envolvidos nas decisões administrativas e produções legislativas. Por fim, o terceiro capítulo abordará o cerne desta dissertação que é a relação entre a corrupção e o Princípio Geral da Transparência Administrativa. Como será visto, falar em combate à corrupção dentro do Direito Administrativo, ou seja, falar sobre o Direito Administrativo da Corrupção é falar, principalmente, sobre as formas de prevenção contra a corrupção. A primeira parte deste capítulo, aprofundará a história e a natureza jurídica da transparência administrativa, as suas dimensões, a sua relação com a publicidade e o acesso às informações, a sua importância para a efetividade do princípio da imparcialidade, para o gerenciamento do conflito de interesses e, também, para a confiança dos cidadãos no Estado Democrático de Direito. E no último item, serão discutidos os meios existentes para a luta contra a corrupção e qual é o papel da transparência administrativa neste âmbito. Sendo assim, este capítulo será dividido entre: I. A história da Transparência e as suas ramificações doutrinárias; II. A Publicidade e o Acesso às Informações; III. O Princípio Geral da Transparência Administrativa; e, IV. As formas de Prevenção contra a corrupção.This dissertation aims not only to investigate the General Principle of Administrative Transparency, but also (and, perhaps mainly) to analyze the forms of prevention against corruption and to verify the role of administrative transparency in this scenario.The first chapter has as its central objective the study of how and why corruption has been dealt with by Administrative Law in recent years. And, for this, it is extremely important to keep in mind what is covered by corruption. However, as it is an overly complex topic, only the fundamental issues for the development of this work will be addressed. Which are: I. The relationship between the Democratic Rule of Law and Corruption; II. The multifaceted character of Corruption; III. If there is a definition of corruption; and, IV. What makes up the so-called Administrative Corruption Law and its benefits in the fight against corruption.The second chapter will address the values ​​and principles of Administrative Corruption Law. Initially, a brief introduction will be made about the concepts of Good Administration and Public Governance and we will see how they are related to the principles and values ​​of Administrative Corruption Law.Entering this point effectively, the concepts of ethics and morals will be studied in order to realize the importance of the value of public ethics and the Principle of Administrative Morality. These themes have a close relationship with the value of trust and the consequent legitimacy of the Democratic Rule of Law. In this way, a brief explanation of this value will be made. In addition, the Principle of Impartiality will also be discussed in this item. Generally, the focus here is related to cases of impediment and suspicion, which are usually defined by law. However, a step back will be taken to analyze with greater intensity the interests involved in administrative decisions and legislative productions.Finally, the third chapter will address the core of this dissertation, which is the relationship between corruption and the General Principle of Administrative Transparency. As will be seen, talking about fighting corruption within Administrative Law, that is, talking about Administrative Corruption Law is talking, mainly, about ways of preventing corruption.The first part of this chapter will delve into the history and legal nature of administrative transparency, its dimensions, its relationship with publicity and access to information, its importance for the effectiveness of the principle of impartiality, for the management of conflict of interest and, also, for the confidence of citizens in the Democratic Rule of Law. And in the last item, the existing means of fighting corruption and the role of administrative transparency in this area will be discussed. Therefore, this chapter will be divided between: I. The history of Transparency and its doctrinal ramifications; II. Publicity and Access to Information; III. The General Principle of Administrative Transparency; and, IV.
