Firstly, we will analyze the evolution of the lease, framing the Lease in its various modalities as inserted in that general and broader figure, tracing its historical evolution and analyzing the main points of turn that the various legislative interventions have brought over time, verifying the nature of the tenant's right arising from this relationship as well as the main obligations of the parties, in particular on the side of the lessor, the obligation to deliver the thing and the obligation to provide and assure the lessee the enjoyment of the thing, of payment of the rent, an obligation that the guarantor will essentially guarantee, as well as the consequences of the delay and lack of payment of rent.The following chapter is dedicated to the Guaranty and the general analysis of this figure, we present thus general notions and characteristics of this figure and we will see how the relations between creditor and guarantor, external relation, of Guaranty tout court or stricto sensu are processed and the relations between debtor and guarantor, cover relation.The last chapter refers to a detailed analysis of the Guaranty in the lease agreements and the legal position of the guarantor, in particular the admissibility of this guarantee, the clarification of the interpretation given to the regime of revoked art. 655.º, problematizing the current regime of this guaranty and presenting solutions, especially with regard to the untying of the guarantor.A presente dissertação versa sobre a posição jurídica do fiador no contrato de Arrendamento e visa deslindar as possíveis incertezas que a vinculação fidejussória neste campo pode actualmente trazer.
