Three steps to discomfort the teaching of law from the humanities

Resumo: | Those of us who cultivate Law and Literature, propose as an option to make the formalism that occurs in the teaching of Law more flexible, the incorporation of Art in the classroom. For this, it is necessary to face, first, the challenge posed by the interdisciplinary, specifically, the relationship between Law and Humanities. In this regard, American academics Jack Balkin and Sanford Levinson have pointed out that the relationship between Law and the Humanities is "uncomfortable." To account for this characteristic in Latin American Law, we will describe (1) the study plan of the career and the division that is at the base of it, that is, Code subjects and subjects that are not Code subjects. Then, we will use (2) the "internalist" and "externalist" approach of the aforementioned academics, to analyze said study plan in its methods and the attitudes it promotes. Finally, we will conceptualize (3) the prescriptivist attitude of Law, to account for the type of student that is expected to be formed in legal classrooms. I will end (4) with some conclusions that will give clues as to how, based on the three previous points, the relationship between Law and Humanities can be favored and Art has a relevant space in Latin American Law Schools. |

Para ello es necesario afrontar, primero, el reto que supone lo interdisciplinario, en específico, la relación entre Derecho y Humanidades. Sobre el particular, los académicos estadounidenses, Jack Balkin y Sanford Levinson, han señalado que la relación que se produce entre Derecho y Humanidades es “incómoda.” Para dar cuenta de esta característica en el Derecho Latinoamericano, describiremos (1) el plan de estudios de la carrera y la división que se encuentra a la base de él, esto es, asignaturas de Código y asignaturas que no son de Código. Luego, recurriremos (2) al abordaje “internalista” y “externalista” de los académicos ya citados, para analizar dicho plan de estudios en sus métodos y las actitudes que promueve. Por último, conceptualizaremos (3) la actitud prescriptivista del Derecho, para dar cuenta del tipo de estudiante que se espera formar en las aulas jurídicas. Terminaré (4) con algunas conclusiones que darán pistas de cómo, en base a los tres puntos anteriores, se puede favorecer la relación Derecho y Humanidades y hacer que el Arte tenga un espacio relevante en las Facultades de Derecho de Latinoamérica.Nós que cultivamos o Direito e a Literatura, propomos como opção para flexibilizar o formalismo que ocorre no ensino do Direito, a incorporação da arte na sala de aula. Para isso, é preciso enfrentar, primeiramente, o desafio colocado pela interdisciplinaridade, especificamente, a relação entre Direito e Humanidades. A esse respeito, os acadêmicos americanos Jack Balkin e Sanford Levinson têm apontado que a relação entre o Direito e as Humanidades é "desconfortável". Para dar conta dessa característica do Direito latinoamericano, descreveremos (1) o plano de estudos da carreira e a divisão que está na base dela, ou seja, disciplinas do Código e disciplinas que não são disciplinas do Código. Em seguida, utilizaremos (2) a abordagem "internalista" e "externalista" dos referidos acadêmicos, para analisar o referido plano de estudos nos seus métodos e nas atitudes que promove. Por fim, conceituaremos (3) a atitude prescritivista do Direito, para dar conta do tipo de aluno que se espera formar nas aulas jurídicas. Terminamos (4) com algumas conclusões que darão pistas de como, com base nos três pontos anteriores, a relação entre Direito e Humanidades pode ser favorecida e a Arte tem um espaço relevante nas Escolas de Direito latinoamericanas.
