Resumo: Clarice Lispector (1920-1977), a university graduate in law, provides in her chronicle Mineirinho a representative example of how it is possible to articulate the alternatives of literary expression from legal material. The juridical approach of this text, using the analytical perspective of “legal narrativism”, reveals how the construction of meaning in the reporting of facts is the “abnormality of the exception”. The chronicle Mineirinho is, nevertheless, a privileged narrative space for the examination of the type of narrative strategy that converts the exercise of thinking the difference in the coherence link of the story. To that end, this analysis develops the idea of “going out to the other” as a heteronomous instance that allows one to be the other so that the other can be the one. Finally, there is the juridical-affective idea of compassion, understood as what belongs to the other belongs to my reflection because it affects me, that is, what commits me to it. In addition, there is criticism to the criminal law of the enemy and intellectual stimuli are proposed from the literary culture of Law in the matter of Law Theory.

El abordaje iusliterario de ese texto, empleando la perspectiva analística del ‘narrativismo jurídico’, revela de qué modo la construcción del sentido en el relato de los hechos es la ‘anormalidad de la excepción’. La crónica Mineirinho es, asimismo, un espacio narrativo privilegiado para examinar el tipo de estrategia narrativa que convierte al ejercicio de pensar la diferencia en nudo de coherencia del relato. A este propósito el análisis propone y desarrolla en la idea de ‘salir al otro’ como instancia heterónica que permite ser cada uno otro para ser otro cada uno. Por último, se incorpora a la reflexión la idea jurídico-afectiva de compasión entendida como lo que del otro me pertenece porque me afecta, o sea, lo que me compromete de él. En addenda figuran críticas hacia el Derecho penal del enemigo y propone estímulos intelectuales desde la Cultura literaria del Derecho en materia de Teoría de los Derechos.Clarice Lispector (1920-1977), de formação universitária em Direito, proporciona em sua crônica Mineirinho um exemplo representativo de como seja possível articular as alternativas de expressão literária a partir de material de caráter jurídico. A abordagem jurisliterária desse texto, com emprego da perspectiva analítica do “narrativismo jurídico”, revela de que modo a construção de sentido no relato dos fatos é a “anormalidade da exceção”. A crônica Mineirinho é, mesmo assim, um espaço narrativo privilegiado para o exame do tipo de estratégia narrativa que converte o exercício de pensar a diferença no enlace de coerência do relato. Com tal propósito, a análise alvitra e desenvolve a ideia de “sair para o outro” como instância heteronômica que permite ser cada um outro para ser outro cada um. Por último, incorpora-se à reflexão a ideia jurídico-afetiva de compaixão, entendida como o que do outro me pertence porque me afeta, ou seja, o que me compromete com ele.
