Resumo: The inspiration for this essay comes from the literary short story by Oliver Sacks – The man who mistook his wife for a hat. The proposal is to highlight possible and necessary interfaces between Law and Literature, without neglecting minimum methodological requirements. The object of reflection is the judicial decision and the problem of judicial activism. Specifically, we intend to explore, based on the literary short story, (a) the importance of narrative to Law and (b) the limits of jurisdictional action, all this in the context of the Brazilian Constitution’s thirtieth anniversary. All this, in order to establish a dialogue between Sacks’ story and the main theoretical references that guide the central argument.
