Intellectual imprisonment: the censorship of the state in books that compose remission sentence projects

Resumo: Remission sentence by reading does not have the force of law, but, by resolution 391 of the National Council of Justice (2021), it allows inmates to reduce a few days in prison. In February 2020, however, the Penitentiary Administration Secretariat (SAP), through its Foundation (Funap/SP), censored 12 books that would be part of the itinerant collection for São Paulo prisons. We sought to understand, through Bakhtinian discourse analysis (2010), possible reasons that made these books subject to censorship, but we selected for analysis only Cabo de Guerra, by Ivone Benedetti, for having been a finalist for an important literary prize in 2010 and for its  verbal and imagery narrative. The proposed discussion is based on three axes: history of censorship in Brazil;; purposes of penalties and problematization of Brazilian policy on punishment. We recognize that the dehumanization of convicts in national prisons is aligned with the technical-legal view, despite the national legislation, which values ​​the humanist booklet. We conclude that the silencing and marginalization of prisoners is enhanced by actions such as Funap/SP, especially when it prevents them from knowing books that deal with aspects of life of which they are victims and perpetrators: betrayal, fear, violence and politics.

En febrero de 2020, sin embargo, la Secretaría de Administración Penitenciaria (SAP), a través de su Fundación (Funap/SP), censuró 12 obras que formarían parte de la colección itinerante de las cárceles de São Paulo. Buscamos comprender, a través del análisis del discurso bakhtiniano (2010), las posibles razones que hicieron que estos libros fueran objeto de censura, pero seleccionamos para el análisis solo Cabo de Guerra, de Ivone Benedetti, por haber sido finalista de un importante premio literario en 2010 y por su narrativa verbal e imaginería. La discusión propuesta se basa en tres ejes: historia de la censura en Brasil; Propósitos de las penas y problematización de la política brasileña de penas. Reconocemos que la deshumanización de los reclusos en las cárceles nacionales está alineada con la mirada técnico-jurídica, a pesar de la legislación nacional, que valora la cartilla humanista. Concluimos que el silenciamiento y marginación de los presos es potenciado por acciones como la Funap/SP, especialmente cuando les impide conocer libros de que tratan aspectos de la vida de los cuales son víctimas y perpetradores: traición, miedo, violencia y política.A remição de pena por leitura não tem força de lei, mas, pela resolução 391 do Conselho Nacional de Justiça (2021), permite aos apenados abater alguns dias de prisão. Em fevereiro de 2020, no entanto, a Secretaria da Administração Penitenciária (SAP), por meio de sua Fundação (Funap/SP), censurou 12 obras que fariam parte do acervo itinerante para os presídios paulistas. Buscamos compreender por meio da análise do discurso bakhtiniana (2010) possíveis razões que tornaram esses livros sujeitos à ação censória, mas selecionamos para análise apenas Cabo de Guerra, de Ivone Benedetti, por ter sido finalista de importante prêmio literário em 2010 e por sua narrativa verbal e imagética. A discussão proposta sustenta-se em quatro eixos: histórico da censura no Brasil; literatura como direito humano; finalidades das penas e problematização da política brasileira sobre punição. Reconhecemos que a desumanização dos apenados nos presídios nacionais alinha-se à visão técnico-jurídica, apesar da legislação pátria, que preza a cartilha humanista.
