Law and analysis public policies: what is the news? A teaching experience and a methodology for research

Resumo: What are the relations between the analysis of public policy and the law? How can the approximation of these research fields contribute to an improvement of the development of the institutional capacities inthe policy making process? How a teaching experience can emphasize this question? How different methodologies in Public Policies can choose a kind of approach in Law? This paper will be guided by these main questions. The starting point is that, in Brazil, the formalistic legal logic separates the research fields (law and analysis of public policy), creating obstacles, which obstruct a better governing between the legislative, executive and judicative powers. From the methodological point of view, this text analyses a vivid experience of Master and PhD students from the Faculty of Law, University of Brasilia (FD/UnB), incorporating the aspects of their works, related to the cycle of public policy. The study case was the Law and Analysis of Public Policy discipline, ministered in the second semester of the years 2015 and 2016. We present how the discipline was developed and how the students incorporated and perceived the topic of analysis of public policy in their investigative projects, as well as the discipline’s application in situations. We connected the relative approach of revised literature to the students’ perceptions. The result was a more integrated performance of legal models in the phases of the cycle and periods of public policy can lead an improvement for the performance between the stakeholders of public policy and the operators of law.

Como a aproximação desses campos de pesquisa pode contribuir para a melhoria do desenvolvimento das capacidades institucionais no processo de formulação de políticas? Como uma experiência de ensino pode enfatizar essa questão? Como diferentes metodologias em Políticas Públicas podem escolher um tipo de abordagem em Direito? Este artigo será orientado por essas principais questões. O ponto de partida é que, no Brasil, a lógica jurídica formalista separa os campos de pesquisa (direito e análise da política pública), criando obstáculos que impedem uma melhor governança entre os poderes legislativo, executivo e judiciário. Do ponto de vista metodológico, este texto analisa uma experiência vivenciada pelos estudantes de Mestrado e Doutorado da Faculdade de Direito da Universidade de Brasília, incorporando os aspectos de suas pesquisas, relacionadas ao ciclo de Políticas Públicas. A experiência analisada foi a disciplina de Direito e Análise de Políticas Públicas, ministrada no segundo semestre de 2015 e 2016. Apresentamos como a disciplina foi desenvolvida e como os alunos incorporaram e perceberam o tema de análise de Políticas Públicas em seus projetos de investigação, bem como a aplicação da disciplina em situações concretas. Conectamos uma abordagem baseada na literatura revisada às percepções dos alunos.
