COVID-19 AND PROTECTION OF RIGHTS IN FEDERAL JUDICIARY: ACTORS, INTERESTS AND ISSUE AREAS OF THE PANDEMIC JUDICIALIZATION: ACTORES, INTERESES Y ÁREAS TEMÁTICAS DE LA JUDICIALIZACIÓN PANDÉMICA

Resumo: This paper estimates a statistical model that explains the factors that have determined the judicial protection of rights in cases related to the theme “COVID-19” in the Brazilian Federal Judiciary. Using multilevel statistical analysis method, the results revealed that the probabilities of obtaining judicial protection depends of a complex interaction between procedural characteristics that identify the profiles of authors, their underlying interests and the topic involved in the discussion. Analyses of the different lawsuit profiles also showed that states, the Federal District and municipalities were the most successful authors in obtaining favorable judicial decisions in demands associated with the subject of making the application of legal rules more flexible. The model also suggests that the Federal Judiciary did not allow itself to be contaminated with “polarization”, preferring, for legal reasons, the maintenance of the status quo to allocating rights in favor of authors from any of the extremes of the current political moment.

Utilizando el método de análisis estadístico multinivel, los resultados revelaron que las probabilidades de obtener protección judicial dependen de una interacción compleja entre características procesales que identifican los perfiles de los autores, sus intereses subyacentes y el tema involucrado en la discusión. Los análisis de los diferentes perfiles de litigios también arrojaron que los estados, el Distrito Federal y los municipios fueron los autores más exitosos en la obtención de decisiones judiciales favorables en demandas asociadas al tema de flexibilización de la aplicación de las normas legales. El modelo también sugiere que el Poder Judicial Federal no se permitió contaminarse con la “polarización”, prefiriendo, por razones legales, el mantenimiento del statu quo a la asignación de derechos a favor de los autores de cualquiera de los extremos del momento político actual.Este artigo estima um modelo estatístico explicativo dos fatores que determinaram a tutela judicial de direitos em casos relacionados com o tema “COVID-19” na Justiça Federal do Brasil. Por meio do uso de um método de análise estatística multinível, os resultados revelaram que as probabilidades de obtenção da tutela judicial dependeram de uma complexa interação entre características processuais que identificam os perfis de autores, seus interesses subjacentes e o tema envolvido na discussão. Análises dos diferentes perfis de ações judiciais também evidenciaram que estados, Distrito Federal e municípios foram os autores de maior sucesso na obtenção de decisões judiciais favoráveis em demandas associadas com o tema da flexibilização da aplicação de regras jurídicas.
