COVID-19 IN BRAZIL AND SOCIALLY VULNERABLE GROUPS: FROM THE RECOGNITION OF NEEDS TO THE INSTITUTIONALIZATION OF RIGHTS

Resumo: | This text proposes to develop an approach on the consequences arising from the pandemic resulting from the covid-19 in the Brazilian context, especially for socially vulnerable groups, in order to demonstrate that the theory of fundamental human needs is an apt instrument for understanding poverty from the institutional perspective of human rights. Initially, conceptual aspects related to the theme in focus are verified, and then we analyze the moral justification of human rights based on the identification of certain basic needs common to all people, in order to base human rights as channels of care. of those needs. The method of procedure used is descriptive-analytical, from consultations with legal texts and bibliographies inherent to the fields of health, social, philosophical and political, always seeking to guide the thematic axes of the study. It appears that for the elaboration of a viable social justice proposal, the focus on the social sciences is necessary, above all, for methodological and argumentative elaboration of the discussion. In fact, the very interdisciplinary character of this text is already sufficient to justify that in legal analyzes involving certain social groups of society such as ours, the primary concern that arises is the construction of a central objective, traversing public health, economic problems , political and urban, due to the effects caused by the pandemic of the covid-19 that plagues the planet and especially a considerable Brazilian population that is in a situation of full economic vulnerability. So that in this text there is a transformation of a problem originally social, but which has a legal dimension, in an object of multidimensional study, thus making it possible to answer not only the legal demands, but also the moral, social, economic, urban questions and policies. |

So that in this text there is a transformation of a problem originally social, but which has a legal dimension, in an object of multidimensional study, thus making it possible to answer not only the legal demands, but also the moral, social, economic, urban questions and policies.Este texto se propõe a desenvolver uma abordagem sobre as consequências advindas da pandemia decorrente da covid-19 no contexto brasileiro, notadamente para os grupos socialmente vulneráveis, no sentido de demonstrar que a teoria das necessidades humanas fundamentais é um instrumento apto para a compreensão da pobreza a partir da perspectiva institucional dos direitos humanos. De início, são verificados aspectos conceituais relacionados com a temática em foco, para em seguida analisar a justificação moral dos direitos humanos a partir da identificação de determinadas necessidades básicas comuns a todas as pessoas, no intuito de fundamentar os direitos humanos como sendo canais de atendimento das referidas necessidades. O método de procedimento utilizado é o descritivo-analítico, a partir de consultas à textos jurídicos e em bibliografias inerentes aos campos da saúde, social, filosófico e político, sempre buscando nortear os eixos temáticos do estudo. Constata-se que para a elaboração de uma proposta de justiça social viável, o enfoque no âmbito das ciências sociais é necessário, sobretudo, para elaboração metodológica e argumentativa da discussão. Aliás, o próprio caráter interdisciplinar desse texto já é suficiente para justificar que em análises jurídicas que envolvam determinados grupos sociais de sociedade como a nossa, a preocupação primordial que se coloca é a construção de um objetivo central, perpassando por problemas de saúde pública, econômico, político e urbano, devido aos efeito causados pela pandemia da covid-19 que assola o planeta e especialmente um considerável contingente populacional brasileiro que se encontra em situação de plena vulnerabilidade econômica.
