Resumo: Destaca que a coleta, transferência e processamento de dados pessoais, como meios de investigação e obtenção de material incriminador referente ao proprietário de tais dados, envolve medidas que afetam um direito fundamental: o direito à proteção de dados pessoais. Sendo assim, enfatiza que a legítima interferência das autoridades competentes para fins de repressão, investigação e processo criminal, deve estar em conformidade com as normas e princípios orientadores de qualquer medida de investigação que afeta direitos fundamentais, tanto para legitimar tal medida quanto para obter evidência de acusação legal.
