Tendo um relevante valor para a sociedade moderna, pois aborda questões da nova estrutura da entidade familiar, que não é mais composta nos padrões definidos no Código Civil de 1916. Este estudo procura analisar a nova estrutura familiar e as mudanças ocorridas com o Código Civil de 2002, no que tange aos direitos inerentes a esta nova estrutura familiar e a evolução do direito. Assim devemos entender como foi à evolução da constituição de família e a forma de sucessão entre parentes, cônjuge e companheiros até os tempos atuais. Os resultados deste estudo procura distinguir a posição do concubinato adulterino na legislação pátria e discorrer sobre os respectivos direitos que essa relação tem resguardos.The research will make an approach to family law and inheritance law, discussing its history, concept, positioning and doctrinal research will jurisprudencial. This study seeks to analyze the new family structure and the changes to the Civil Code of 2002 with respect to the rights inherent in this new family structure and evolution of the law. So we understand how was the evolution of family formation and shape of succession among relatives, spouses and companions until today. The results of this study seeks to distinguish the position of concubinage adulterous on country legislation and discuss their rights that this relationship has shields. Having a significant value to modern society as it addresses issues of the new structure of the family unit, which is no longer made in the standards set out in the Civil Code of 1916.
