A Lei nº 8.666/93 contempla as normas gerais sobre licitação no Brasil, sujeitando às suas normas todos os órgãos da administração direta dos quatro entes federativos e também às entidades que compõem a administração indireta do Estado. Além de inúmeras regras, a Lei nº 8.666/93 também enumera os princípios que devem orientar as licitações, tais como o da legalidade, igualdade, impessoalidade, publicidade, moralidade, vinculação ao instrumento convocatório, julgamento objetivo etc. Além das modalidades licitatórias previstas na Lei nº 8.666/93, a Medida Provisória nº 2.182-18, de 23 de agosto de 2001, depois convertida na Lei nº 10.520, de 17 de julho de 2002, que criou uma nova modalidade, denominada pregão, para a contratação de bens e serviços comuns. Nesse contexto, a figura do “carona”, que diz respeito à possiblidade de adesão à Ata de Registro de Preços por órgão ou entidade que não participou da licitação, é legalmente possível nas modalidades concorrência e pregão. Não obstante, há claros limites para a adesão à Ata de Registro de Preços por parte do “carona”. O presente estudo traz o entendimento de doutrinadores envolvidos com a temática abordada.The procurement of works, property and services by the administration is bound by duty to tender, provided by the 1988 Federal Constitution in its Article 37, item XXI. The Law No 8.666/93 includes the general rules on tendering in Brazil, subject to their standards all bodies of the direct administration of four federal entities and also the entities that make up the indirect administration of the State. In addition to numerous rules, the Law No 8.666/93 also lists the principles that should guide the tendering, such as legality, equality, impartiality, publicity, morality, binding to the calling instrument, judgment, objective etc. In addition to the tendering procedures provided for by Law No 8.666/93, the Provisional Measure No. 2182-18 of August 23, 2001, later converted into Law No. 10520 of July 17, 2002, which created a new type, called auction, for the hiring of common property and services. In this context, the figure of the "ride", which concerns the possibility of accession to the Act of Registry Prices per body or entity not involved in the tendering, is legally possible in the competition and auction arrangements. Nevertheless, there are clear limits to join the Act of Registry Prices by the "ride".
