Entretanto, além de benefícios, a grande rede trouxe consigo novas formas de conflitos e violações de direitos. Para facilitar a localização dos web sites foi criado o sistema de nomes de domínio. Esse sistema visa a transformar uma seqüência numérica, que é a identidade dos computadores na rede, em palavras que fossem facilmente memorizadas como endereços dos sites. Ocorre que esse sistema ainda não é devidamente regulamentado pelos ordenamentos jurídicos e os nomes utilizados para a criação dos endereços eletrônicos ou URLs obedecem geralmente ao princípio da ordem de chegada para o registro dos nomes de domínio. Esta prática acaba por proporcionar a oportunidade de criação de sites que utilizam nomes de marcas já registradas, causando assim uma grave violação ao direito de terceiros o que acarreta confusão e induzimento ao erro a vários consumidores e usuários da Internet. Ademais, tal usurpação pode gerar o desvirtuamento de marcas que oferecem produtos ou serviços já consolidados no mercado, prejudicando assim nomes empresariais ou de pessoas físicas. Diante desse problema se faz necessário uma regulamentação adequada bem como a criação de vias alternativas que possibilitem prevenir e dirimir tais conflitos.The advent of the Internet was an important technological milestone that revolutionized human relationships. However, in addition to benefits, the large network has brought about new forms of conflicts and violations of rights. To facilitate the location of web sites was created the system of domain names. It aims to transform a numeric sequence, which is the identity of computers on the network, in words that were easily remembered as web site addresses. It turns out that this system is still not properly regulated by laws and the names used for the creation of email addresses or URLs generally obey the principle of first come first served for the registration of domain names. This practice ultimately provide the opportunity to create sites that use trademarks registered by other, causing a serious violation of the rights of third parties which leads to the inducement to error and confusion to many consumers and Internet users. Moreover, such misuse can lead to damage of trademarks that offer products or services already established in the market, reaching companies and personalities.
