Monografia (Graduação) - Universidade Católica de Brasília, Brasília, 2009.https://repositorio.ucb.br:9443/jspui/handle/10869/3246DireitoO presente trabalho tem o escopo de traçar o entendimento social acerca da morte (tânatos), desde a concepção sugerida ao termo na antiguidade, por meio da análise das sociedades antigas: grega e romana; bem como as implicações em cada um dos ordenamentos jurídicos e estruturas sociais, como, por exemplo, as instituições civis. Será evidenciada, ainda, a abordagem realizada pelo direito brasileiro contemporâneo sobre o tema em questão e as suas principais figurações no cotidiano social dos cidadãos, com a repercussão nos âmbitos civis- patrimoniais, tributários e penais; além de traçar um estudo comparado sobre a morte e o instituto do direito sucessório causa mortis. Não obstante, busca ainda, dentro do ordenamento jurídico brasileiro, demonstrar a influência dos valores religiosos, filosóficos e científicos sobre a morte na legislação existente, como por exemplo, as garantias estabelecidas pelos princípios fundamentais elencados no art. 5º da Constituição Federal (proteção à inviolabilidade de crença a cultos religiosos e liturgias e garantia do direito de herança) e a tutela do Estado ao sentimento de respeito aos mortos, garantido pelo Código Penal Brasileiro.This work has the aim of creating understanding about the social death (tânatos), from design suggested the term in antiquity, through the analysis of ancient societies: Greek and Roman, and the implications in each of the jurisdictions and social structures, such as the civil institutions. It will be evident, yet the approach undertaken by the contemporary Brazilian law on the subject in question and its figurations in everyday social citizens, with the impact on civilian areas, property, tax and criminal, than draw a comparative study on the death and the Office of inheritance law cause of death.
