A corrente majoritária e a doutrina predominante entendem ser a fase inquisitorial, no processo penal brasileiro, apenas mero instrumento investigatório acerca dos elementos e provas eventualmente colhidos. Entretanto, em razão dos valores e direitos fundamentais estabelecidos na nossa Constituição, é necessário que sejam avaliadas as garantias que o Princípio do contraditório proporcionariam aos indiciados na fase investigativa e as posições favoráveis. Nesse sentido, por ser alvo de várias discussões, inclusive com a nova abordagem atribuída pelo Anteprojeto de reforma do Código de Processo Penal, é de grande valia a análise das mudanças trazidas e a verificação do princípio constitucional do contraditório em todas as fases da instrução processual. É almejada uma compreensão aprofundada do referido princípio, principal objeto desta pesquisa, e das demais garantias estendidas ao investigado desde o início da acusação.This study analyses the applicability of the right to contradictory during the police investigation, consolidated by the article 5, lV of the 1988 Constitution. The current majority and prevailing doctrine regard the inquisitorial stage in the criminal brazilian proceedings, just mere instrument investigative about the evidences and the elements eventually obtained. However, due to the values and fundamental rights estabilished in our Constitution, it is important to evaluate the guarantees that the adversarial principle will provide to the defendants during the investigation and the favorable position. In this sense and because of the several discussions about this, including with the new approach given by the preliminary draft reform of the Criminal Procedure Code, it is valuable to analyze the changes brought about it and to study the applicability of the adversarial principle in all stages of procedural instruction.
