Insere-se, nesse contexto, o papel desempenhado pelos agentes econômicos no processo de degradação ambiental e a consequente responsabilidade socioambiental desses agentes, em especial, quando tomadores de crédito. A análise é realizada com base na legislação ambiental relacionada à regulação dos projetos econômicos com ênfase para a atuação do setor financeiro na viabilização de projetos sustentáveis. Evidencia-se ainda, a internalização de passivos ambientais pelos agentes econômicos chegando a atingir as instituições financeiras. Destaca-se, por conseguinte, a questão da concessão de crédito no mercado financeiro. A posição adotada pelos tribunais nacionais e a experiência similar de outros países é igualmente abordada. Apesar de fenômeno recente e ainda não consolidado sob o aspecto jurisprudencial busca-se observar a repercussão proveniente da adoção desse tipo de legislação.This work is scope for the study of civil responsibility of financial institutions for environmental damage arising from the grant funding. Falls in this context, the role played by economic agents in the process of environmental degradation and the consequent social and environmental responsibility of these agents, especially when borrowers. The analysis is performed based on environmental legislation related to regulation of economic projects with emphasis on the performance of the financial sector in achieving sustainable design. Evidence is also the internalization of environmental liabilities by economic agents peaking at financial institutions. It highlights, therefore, the issue of credit in the financial market. The position adopted by the courts and the similar experiences of other countries is also addressed.
