As garantias que se podem conferir a tais seres em solo pátrio tendo por base os muitos instrumentos internacionais, tais como tratados, conferências e a Assembléia das Nações Unidas que visam protegêlos, principalmente, dos atos pedofílicos que tomaram impulso com o surgimento da rede mundial de computadores. Com a promulgação da Constituição da República Federativa do Brasil de 1988 e as garantias expressas no art. 227 deste mesmo diploma legal, as mudanças se fizeram sentir nitidamente. Deixou-se para traz o Código de Menores e a doutrina da situação irregular, passando-se a usar a designação criança e adolescente, muito mais significativa para o modelo de proteção pretendida. Daí surgiu o Estatuto da Criança e do Adolescente que no artigo 1º ratificou a doutrina da proteção integral pretendida pelo constituinte. O novo Direito visa assegurar às crianças e aos adolescentes “todos os direitos fundamentais inerentes à pessoa humana”, no seu artigo 3º, bem como o combate às condutas relacionadas à pedofilia na “Internet” assegurada pela alteração trazida a lume pela Lei 11.829 de 25 de novembro de 2008.The preoccupation with the childrens since imemorables times along of the history (até) the acttualy days is the basic objective of this monografy. The garanties that in our country to these peoples with the base in very internationais instruments, like is United Nations that drives at to protect, principaly, actos of pedophiles that increase with the appearing of the Internet. Whith the promulgation of the Constitution of Republic of Brazil and the guarantees expressed in the article 227 of this legal diploma, the transformation was evidents. Was disregarded the Juvenile Code and the douctrina of irregular situation with the denomination of childrens and adolescent, most meaningful to the model of protection wanted. In this way, arised the Childrens and Juvenile Estatuto that in its article 1º ratifies the doctrina of integral protection wanted by the statesman.
