Antigamente a esfera judiciária não podia revisar os atos administrativos, devido ao princípio da separação dos poderes. A própria Administração tinha o papel de legislar, executar e revisar os seus próprios atos. Com o passar do tempo, foi se aprimorando o pensamento de que nem todos os atos da administração eram imunes ao Poder judiciário. Dessa forma, vários princípios constitucionais passaram a ser fundamento para análise da discricionariedade. Atualmente, diversas jurisprudências pacificam o entendimento de que a discricionariedade é absolutamente controlável, uma vez que, diante da liberdade dada ao administrador para agir conforme a melhor opção, a ele se devem aplicar limites para que não use a competência atribuída pela lei de forma abusiva ou arbitrária.The work in question will address the jurisdictional control of administrative discretion, regarding historical aspects and its concept as well as the principles governing the discretion to reach the scope of judicial review. Previously the judiciary could not review the administrative acts, given the principle of separation of powers. The Administration itself had a role to legislate, implement and review their own actions. Over time, has been refining the thought that not all administrative acts were immune to the Judiciary. Thus, several constitutional principles became the foundation for the analysis of discretion.
