Diante disso, frente à atualidade, acessibilidade de seu objeto, bem como a relevância social, técnica e operacional que envolve o tema da juridicidade do erro médico analisado sobre a responsabilidade civil médica em cirurgia plástica estética, e conseqüentemente a reparação, seja ela moral, estética ou através de indenização por lucros cessantes; justifica-se dessa forma a escolha do tema para confecção do trabalho de conclusão do curso. Este trabalho pretende demonstrar qual é a responsabilidade do médico cirurgião plástico, nos casos de intervenções cirúrgicas com cunho estético quando este erra, provocando dano ao paciente, ou não alcançando o resultado desejado. Para responder essa questão será realizada uma abordagem no contexto geral das normas fundamentais do Direito no que tange a responsabilidade civil, partindo para o estudo das questões mais debatidas, quanto à responsabilidade médica no tocante à cirurgia plástica estética.This study aims to clarify some of those who seek the judiciary in order to see the damage caused by the conduct of aesthetic plastic surgeon be refunded. Thus, compared to today's theme, the accessibility of its object, as well as social relevance, technical and operational issue involving the legal status of medical error analysis on medical liability in aesthetic plastic surgery and subsequent repair, be it moral, aesthetics or through damages for lost profits, thus justified the choice of theme for making the work of completing the course. This paper aims to show what is the responsibility of the physician plastic surgeon in cases of surgical interventions and personal aesthetics when it misses causing harm to the patient or not achieving the desired result.
