Monografia (Graduação) - Universidade Católica de Brasília, Brasília, 2007.https://repositorio.ucb.br:9443/jspui/handle/10869/3404DireitoEm substituição das antigas duras penas, como a de morte e mutilações, depois do final da vingança pública, surgiram, no século XVI, os primeiros sistemas penitenciários, que com o passar do tempo, visavam além do caráter retributivo absoluto da pena, outras finalidades como a prevenção e a readaptação do apenado à sociedade. O trabalho do preso foi posteriormente adicionado para o auxilio nessa readaptação. Ocorre que desde o início os sistemas penitenciários apresentaram problemas, principalmente no aspecto de ressocialização do convicto. A legislação atual brasileira conta apenas com a Lei de Execuções Penais para lidar com tão amplo problema, que envolve mormente o descompromisso Estatal e da sociedade com o tema e a escassez verbas para realização de estruturas e projetos. No meio desta conjuntura, os deveres e direitos do preso são postos em segundo plano de importância. A terceirização dos sistemas prisionais em conjunto com o efetivo uso da previsão legal do trabalho do preso, podem, se não resolver, atenuar em alto grau os problemas atuais advindos da atual forma de cumprimento da pena por privação da liberdade.In place of old tough penalties, such as the death and mutilation, after the end of public revenge, appeared in the sixteenth century, the first penitentiary system, which over time, aimed beyond the absolute character of the penalty, other purposes as the prevention and the rehabilitation of the convict to society. The work of the arrested was later added in assistance of this rehabilitation. It occurs that since the outset the penitentiary system, it had problems, especially in the aspect of the resocialization. The current Brazilian legislation count only to the Law of Criminal Executions to deal with this wide problem, especially involving the lack of compromise of State and society to this matter and the lack funds for completion of structures and projects. Amid this climate, the duties and rights of the arrested are placed in the background of importance.
