As penas previstas no artigo 28 da Lei de drogas são inócuas no que tange a sua execução. Não há meios de conduzir o infrator à acatar a pena determinada judicialmente, uma vez que o seu não cumprimento não acarretará qualquer consequência. A Lei de drogas, no contexto social atual, se tornou ineficiente frente ao grande crescimento do tráfico de drogas e dessa forma consequentemente do uso e porte de droga. A ineficiência das transações penais para o usuário de drogas favoreceu o surgimento de um projeto de lei que visa a modificação da referida lei no que tange o artigo 28, principalmente quanto as penas.The changing of the Drug‟s Law (Act of number 11.343/06) brought with it among others consequences the differentiated treatment to a drugs user, who becomes being treated no long as a delinquent but a sick person, once there‟s no deprivation of freedom for it anymore, but only alternative resolutions. The penalties foreseen on the article of number 28 from the Drug‟s Law are innocuous about its execution. There‟s no ways to conduct the violator to consent the penalty judicially determinate, once that the non-fulfillment doesn‟t result in any consequence. The Act, inside the current context, became an inefficient wall to the great development of drugs traffic and consequently the use and the carry of drugs.
