Monografia (Graduação) - Universidade Católica de Brasília, Brasília, 2012.https://repositorio.ucb.br:9443/jspui/handle/10869/2011DireitoA presente monografia tem por objetivo verificar quais as possibilidades legais para promover a internação compulsória como forma de garantir aos dependentes químicos e ébrios habituais um tratamento terapêutico adequado, assegurando assim o bem maior denominado vida em observância ao principio da dignidade da pessoa humana e da saúde em sua plenitude. Com vistas a reduzir a prática de crimes associados ao uso de drogas em geral e garantir a eficácia da ordem social. Apontando que os desajustes sociais provocados pela dependência química produzem conotações entre a criminalidade e a intimidação social. A busca por uma maior atuação do poder público se mostra necessária, ao passo que devido à inércia Estatal, os princípios basilares legais restam prejudicados. Abordando que o modelo pelo qual se opera a intervenção legal deve refletir exatamente o modelo cuja realização se pretende, dentro da estrita legalidade, aplicando-se a medida individualizada a cada caso concreto, mediante acompanhamento médico, judicial e do ministério público, restringindo-se a autonomia de vontade, apenas aos casos que se enquadrarem nesse contexto, em conformidade com o Projeto de Lei do Senado n° 111/10, que também determina que o combat e ao tráfico de drogas terá o apoio das Forças Armadas, "com ênfase nas áreas de fronteira". Prevendo ainda, aplicação de multas aos usuários de drogas ilícitas, alterando-se a lei 11.343 de 23 de agosto de 2006 para fixar a pena de internação compulsória para o tratamento de dependentes químicos e ébrios habituais, dispondo ao final sobre as condições legais dessa internação.The present paper aims at studying the possibilities to promote the legal compulsory hospitalization as a way of ensuring that addicts and habitual drunkards appropriate therapeutic treatment, thereby ensuring the greatest good life named in compliance with the principle of human dignity and health in its fullness. In order to reduce the crimes associated with drug use in general and ensure the effectiveness of the social order. Noting that the discrepancies caused by substance abuse social connotations produce between crime and social bullying. The search for greater performance of the government appears necessary, while the State due to inertia, the basic principles remain legal harmed.
