Resumo: A possibilidad e do ensino domiciliar no Brasil já é uma re ali dade, porém a legislação não avança com a mesma celeridade do fato social, assim o presente art igo é uma ferrament a para verificar s e a pratica do ensino domicilia r é também uma rea li dade poss ível no ordenamentojurídic o p átrio . Se os princípios que regem a Constituição Federal, do Direito Civil, o Estatuto da Criança e do Adolescentes são suficientes para satisfazer o elemento jurídico e legal do ensino domiciliar ou se estes são obstáculos para a sua realização. Nesse contexto, busca se por meio da hermenêutica jurídica demonstrar que há apenas um aparente conflito legal ,porém os princípios orientadores do ordenamento jurídico Brasileiro estão em harmonia com a prática do ensino do mi ciliar e que a sua realização não re pre senta dano s a os direitos do menor , sendo que enquanto fato social pode representar uma solução para as dificuldades encontradas na prestação do direito à educação que é dever Est ado.

Whether the principlesgoverning the Federal Constitution, Civil Law, the Statute of Children and Adolescents aresufficient to satisfy the legal and legal element of home schooling or whether these are obstacles to i ts realization.
