O Estado tem o dever de realizar o direito à saúde através de formulação e implementação de políticas públicas. Ocorre uma omissão ou insuficiência do Poder Público na adoção de programas ou ações voltadas para as prestações de saúde. A sociedade na busca para que as prestações da saúde sejam efetivadas, procura amparo no Judiciário, visto que o Estado não cumpre o seu papel. Assim, há um aumento de demandas judiciais, em atenção às individuais, ocorrendo o fenômeno judicialização da saúde. Dentro desse contexto, se faz a análise de qual direito deve ter precedência sobre o outro, se a busca pela vida saudável do indivíduo tem que ser preservada ou o interesse coletivo deve ser maior. É feita uma abordagem sobre uma possível intervenção do Judiciário na implementação de políticas públicas, o impacto que as decisões judiciais causam no orçamento público. Além disso, serão considerados os limites que são impostos ao juiz, como a cláusula da reserva do possível e princípios que deverão ser levados em consideração pelo magistrado, cita-se o princípio da proporcionalidade, mínimo existencial, sendo este, condições mínimas que devem ser garantidas ao individuo para que possa ser garantida sua dignidade.The present work deals with individual and collective conflicts concerning the right to health, the full implications that arise when you have a fundamental right fully effective and immediate applicability. The State has the duty to realize the right to health through the formulation and implementation of public policies. There is an omission or inadequacy of public authorities in the adoption of programmes or actions focused on the health benefits. Society in the quest for health benefits take effect, since the courts support the State does not fulfil its role. Thus, there is an increase in litigation, in attention to the individual, the judicialization of health phenomenon. Within this context, the analysis of which law should take precedence over the other, if the search for the healthy lifestyle of the individual have to be preserved or the collective interest should be increased. Is made an approach about a possible intervention by the Judiciary in the implementation of public policies, the impact of judicial decisions cause in the public budget.
