O ordenamento constitucional vigente apresenta, entre outras virtudes, o zelo pela pessoa humana e sua dignidade. O autor não é mais a mesma figura do século XVIII, em especial por conta da Revolução Tecnológica. Os novos rumos da humanidade modificaram os costumes, a economia e, portanto, as leis merecem adequação. Ao artista programador do software o desenvolvimento livre se tornou a solução para o direito de acesso à ciência, cultura e educação. Mas, não só para aquele artista, a sociedade tem seus direitos violados pela apropriação desmedida e exclusiva de um software. Entre liberdade de acesso à informação, livre circulação de dados particulares sem autorização, intervenção estatal com intuito inquisitivo e a falta de segurança na rede, a culpa se estende aos programas de computador proprietários. A nova proposta encontra na função social da propriedade a saída para equilibrar os direitos de autor e o interesse público, ambos consagrados no texto magno.This work represents a new way to understand the software’s property system as the constitutional order demands for human dignity. As the author is not the same 18th-century one, specially for the Technological Revolution, the various modifications on social habits and economy also require a new legal arrangement. Therefore, the artist’s freedom to develop ends as its unique way to pursue the right to access science, culture and education. Likewise, human rights remain offended by the exclusive and rambling property over software. Access to information, unauthorized personal data movement, state intervention, censorship and lack of security all over Internet are problems that remain with proprietary software’s creation .
