Fundamental rights, property and social function: the property’s social function as the foundation of economic, political and social development

Resumo: This present article has the objective to demonstrate the essentiality of Property Rights in the most variable societies, due to its role as a booster to economic, political and social development. Therefore, it is presented the visions of Locke, Hobbes and Hayek regarding property. In a second moment, it wil be presented the definitions for economic, political and social development. Then the Brazilian legislation on the theme is going to be discussed, especially in reference to a social function to be accomplished by the property. It culminates with the definition that societies development depend on the solidification of property as a fundamental institution.

Para ello se presentará la visión de Locke, Hobbes y Hayek con respecto a la propiedad. En segundo momento será discutido sobre los determinantes de desarrollo económico, político y social. Después se presentará la forma en que la legislación brasileña trata el asunto, en especial en lo que se refiere a una función social a ser cumplida por la propiedad. Culminando con la definición de que el desarrollo de la sociedad depende de la solidificación de la institución fundamental de la propiedad.O presente artigo tem o objetivo de demonstrar a essencialidade dos Direitos de Propriedade nas sociedades mais variadas, devido ao seu papel como impulsionador do desenvolvimento econômico, político e social. Portanto, são apresentadas as visões de Locke, Hobbes e Hayek em relação à propriedade. Em um segundo momento serão apresentadas as definições para o desenvolvimento econômico, político e social. Adiante, a legislação brasileira sobre o tema será discutida, em especial em referência a uma função social a ser realizada pela propriedade.
