Esse tema é bastante complexo por envolver os direitos fundamentais do cidadão, consagrados na Carta Maior, e a segurança pública, a qual tem suas bases no poder de polícia do Estado. O abuso de autoridade na abordagem policial é uma agressão ao princípio da dignidade da pessoa humana, aos direitos humanos fundamentais e a outros princípios consagrados na Constituição. Por isso, este trabalho tem por objetivo apresentar um estudo sobre os crimes de abuso de autoridade previstos na Lei nº 4.898/65. Também será alvo de estudo do presente trabalho, a análise da abordagem policial com o fim de estabelecer uma relação entre a necessidade de prevenção e repressão ao crime. A prevenção e a repressão ao crime têm por finalidade a paz social, para isso o Estado deve buscar estabelecer o limite de atuação do agente público para que este não incorra nos crimes previstos na referida lei. O trabalho investigará, ainda, a origem do abuso de autoridade, bem como buscará esclarecer as consequências jurídicas resultantes dessa prática. Será, ainda, explorada a expressão “fundada suspeita”, prevista no Código de Processo Penal, haja vista a vaguidão do termo, o qual pode ser interpretado subjetivamente de diferentes maneiras. Assim, este trabalho de conclusão de curso busca identificar as origens das condutas abusivas na atividade policial a fim de encontrar uma solução para transformar a polícia em uma instituição democrática e cidadã.The misuse of authority at police approach, represents nowadays, a deserving theme of special attention. This theme is quite complex for involving fundamental citizen rights, consecrated in the Federal Constitution, and the public security, whose base is in the power of state police. The misuse of authority at police approach it is an aggression to the principle of human person dignity, to the human fundamental rights and also to other principles consecrated in the Constitution. Therefore, this work objective itself to present a study about misuse of authority crimes provided in Law n.4.8898 65. Likewise it will be aim of study of the present job, the analysis of police approach in order to establish a relation between prevention necessity and crime repression. The prevention and crime repression have social peace as finality, and for that, the state must look for establish an acting limit of the public agent so he would not incurs in provided crimes, in the above mentioned law. This work still will investigate the origin of misuse of authority, and it'll seek for clarify the juridical consequences resulting of this practice. In addition, will be explored the expression, ''founded suspicion" provided in the Code of Criminal Procedure, given the inaccuracy of the term, that can be subjectively interpreted in different ways.
