Decorreu-se com isso, a inserção da função social do contrato na teoria contratual. Os contratos não seguem a forma que, por décadas, prevaleceram, onde o foco do princípio era a autonomia da vontade. As transformações na sociedade, políticas, sociais e econômicas estimularam o contrato a adotar novas formas, indo a favor do interesse social, ignorando o modelo de sua atuação, entre os contratantes, de mero instrumento de realização individual. A utilização da doutrina e da jurisprudência foi definitiva e acompanhou tais inovações, reduzindo com o individualismo jurídico, onde a clássica teoria contratual foi projetada. A função social do contrato foi disciplinada expressamente no Código Civil de 2002, tendo forma de cláusula geral, cabendo ao interpretador do direito, aplicar e limitar o referido princípio, caso a caso, com foco na proteção de valores e interesses patrimoniais que há numa relação jurídica.The present works monograph has as objective analyzes the changes happened in the contract, as well as in the Civil law, stimulated by an influenced society, being of addition importance a revaluation of the contractual right. It was elapsed with that, the insert of the social function of the contract in the contractual theory. The contracts don't follow the form that, per decades, they prevailed, where the focus of the beginning was the autonomy of the will. The transformations in the society, politics, social and economical they stimulated the contract to adopt new forms, going in favor of the social interest, ignoring the model of his/her performance, among the contracting parties, of mere instrument of individual accomplishment. The use of the doctrine and of the jurisprudence it was definitive and it accompanied such innovations, reducing with the juridical individualism, where the classic contractual theory was projected.
