Ao longo do trabalho buscou-se abordar as transformações sociais e econômicas que influenciam o direito contratual contemporâneo e a necessidade de se rever alguns dogmas em relação aos contratos. Focou-se ainda sob a égide do princípio da boa-fé objetiva fundamentar a aplicabilidade desta teoria e dessa forma limitar o direito subjetivo do credor em resolver o contrato quando este sofrer qualquer lesão pelo inadimplemento. No adimplemento substancial busca-se a conservação do contrato, haja vista ser injusto a sua extinção por faltar uma parte ínfima para o cumprimento total da obrigação. Portanto, em se tratando de um inadimplemento de pequena importância, é manifestamente contrário a boa-fé o credor valer-se daquele para nada prestar, isto é, somente se justificaria a extinção contratual quando a lesão incidir diretamente na função econômico-social do contrato sob pena de configurar um enriquecimento sem causa em favor do credor.The current work aims to show the theory of substantial payment contracts, which comes from the British Common Law and it was custom-made by the Brazilian legal system. Throughout the work we try to show the social and economic transformations that have persuade the contemporary contract law and the need to revise some contracts dogmas. It focus on the principle of objective good faith Bottom the applicability of this theory and thus limit the subjective right of the creditor to cease the contract if he suffer any injury by non-compliance. The substantial payment seeks the maintenance of the contract, because it looks like unfair the extinction of the contract by missing a tiny part of the full compliance with the obligation.
