Embora recente, o tema abordado pela referida lei é alvo de discussões doutrinárias e jurisprudenciais há longa data, tendo-se, inclusive, posições acerca do tema por parte dos estudiosos. Dentre os temas mais controversos e discutidos da lei, encontra-se a responsabilidade civil da gestante. Isso ocorre porque a nova lei trás, como requisito para o arbitramento do montante a ser pago, a necessidade da gestante de comprovar tão somente indícios da paternidade do requerido, motivo pelo qual a possibilidade de equívocos se multiplica. Assim, uma vez que o exame de paternidade somente poderá ser realizado após o nascimento com vida do nascituro, e o montante pago a título de alimentos durante a gravidez respeita o princípio da irrepetibilidade, inúmeros poderão ser os prejuízos gerados aquele que, embora tenha custeado as despesas da gravidez não foi declarado pai do menor. Visando erradicar tal problemática a lei de alimentos gravídicos atribuiu à gestante responsabilidade objetiva na ocorrência da supracitada hipótese. Entrementes, o dispositivo foi vetado, razão pela qual persiste para corrente majoritária tão somente a responsabilidade subjetiva da gestante. Dessa forma, eventual ressarcimento, segundo a corrente majoritária, dependerá de prova da culpa ou dolo da mãe do menor.The current work brings new issues brought by the advent of law 11.804/2008, which regulates child support for unborn child. Although the new date, the issue brought by the new law is the subject of doctrinal discussions and jurisprudential long time. We even have positions about the subject by scholars. Among the most controversial and discussed topics of the law, is the liability of the pregnant woman. This is because the new law brings the requirement for the arbitration of the amount to be paid to the pregnant woman need only to show evidence of defendant‟s paternity, so the possibility of confusion is growing. Therefore, once the test of paternity can only be done after birth with life of the unborn child, and the amount paid of child support during the pregnancy is governed by the principle of unrepeatable, many may be the losses generates to that person who, although have paid the amount arbitrated, is not declared father of the child after the pregnancy. Aiming to eradicate this problem, the law assigned to the pregnant strict liability in the event the above hypothesis. Meanwhile, the device was vetoed, why it persists for only the current majority of pregnant subjective responsibility.
