É na Audiência Preliminar que ocorre o primeiro contato do juiz com a partes e dependendo da disponibilidade tanto do autor quanto do réu, esta demanda litigiosa pode chegar ao fim sem que para isto seja necessário longas dilações probatórias. Com o advento da Lei 10.444 de 2002 a qual fez o acréscimo do parágrafo 3° ao artigo 331 do CPC, trouxe um grau elevado de subjetividade do juiz ao declarar que se o direito em litígio não admitir transação, ou se as circunstâncias da causa evidenciarem ser improvável sua obtenção, o juiz poderá, desde logo, sanear o processo e ordenar a produção da prova, ou seja, o legislador atribuiu ao juiz a responsabilidade de se realizar ou não a Audiência Preliminar. Ocorre que a dispensa imotivada desta audiência, pode significar uma demora desnecessária quanto a prestação jurisdicional e a consequente perda da oportunidade de atingir a pacificação social, fato este que desvirtua a previsão dessa audiência que é justamente a celeridade.This monograph aims to clarify the assumptions on which the Preliminary Hearing may be dispensed without this arises from the prejudice to the parties. It is the Preliminary Hearing which the first contact with the parties and judge depending on the availability of both the author and the defendant disputed this demand can reach the end without it being necessary for long delays evidentiary. With the enactment of Law 10,444 of 2002 which made the addition of paragraph 3 of Article 331 of the CPC, has brought a high degree of subjectivity of the judge to declare that the right transaction at issue does not admit, or whether the circumstances of the case reveals be unlikely to obtain it, the judge may then, clean up the case and order the production of evidence, ie, the legislature gave the court the responsibility to decide whether or not the Preliminary Hearing.
