Trabalho de conclusão de curso (Graduação) – Universidade Católica de Brasília, Brasília, 2008.https://repositorio.ucb.br:9443/jspui/handle/10869/4046DireitoDemonstrar de forma clara e objetiva o conflito existente entre a linha tênue da limitação da liberdade de informação e os direitos autorais, na esfera do direito e da informática, onde a internet, como o meio de comunicação existente mais rápido e eficiente do mundo globalizado, se transforma e força o Direito a se adaptar e se transformar com a mesma velocidade. Como transmitir e receber informações no âmbito do mundo virtual, de forma livre, sem desrespeitar ou violar a propriedade intelectual. Apontar os principais problemas que envolvem a temática proposta, bem como enumerar os diversos problemas envolvendo a violação da liberdade individual e a violação dos direitos autorais. Analisar a eficiência da lei que rege os direitos personalíssimos e a lei de direitos autorais e sua aplicabilidade em detrimento às diversas situações enfrentadas na atualidade. Para alcançar os objetivos pretendidos, utiliza pesquisas na doutrina brasileira e internacional, além de uma profunda busca de julgados na esfera nacional e internacional relativos ao tema. Conclui que o assunto proposto no presente trabalho, demonstra que através de estudos e projetos direcionados pode-se elucidar a problemática que concerne esse campo do Direito ainda obscuro, onde a liberdade de compartilhar informações está intimamente interligada aos princípios constitucionais e éticos, a qual esbarra na violação da propriedade imaterial, formando o que se entende por limitação da liberdade de informação e a violação dos direitos autorais.To demonstrate of clear and objective form the existing conflict enters the tenuous line of the limitation of the information freedom and the copyrights, in the sphere of the right and computer science, where the Internet, as the existing media efficient faster in the world, witch transforms and force the law to adapt and to transform with the same speed. How can we transmit and receive information in the scope from the virtual world, in a free way, without disrespecting or violating the copyright. To show the main problems that involves the proposal thematic, as well as enumerating the diverse problems involving the breaking of the individual freedom and the breaking of the copyrights. To analyze the efficiency of the law that conducts the exclusive rights and the law of copyrights and its applicability in detriment to the diverse situations faced in the present time. To reach the intended objectives, it uses research in the Brazilian and international doctrine, beyond a deep search of judged in the national and international sphere relative to the subject.
